(1) transaction negotiation

(2) Application for transfer

Documents to be submitted for trademark transfer:

1. An application for trademark transfer shall be stamped with the seals of the applicant and the assignee. 2. Power of attorney for trademark transfer with the official seal of the transferee. 3. A copy of the business license of the transferee. 4. Pay the trademark transfer application fee and other fees as required. 5. After receiving the application for assignment, the Trademark Office shall issue a Certificate of Approval for Assignment of a Registered Trademark within fifteen days.

(3) Precautions

According to Article 25 of the Regulations for the Implementation of the Trademark Law, identical or similar trademarks registered by trademark applicants/registrants on the same or similar goods/services must be transferred together.

(4) Instructions for filling in the form

1. If an enterprise cancels or an individual dies, and the trademark transfer formalities are not completed within one year from the date of cancellation or death, the trademark transfer formalities can no longer be completed, and the trademark ownership naturally disappears.

2. Where a trademark registrant registers the same or similar trademark on the same commodity or similar commodity, it must be transferred together.

3. Time required: generally 3-5 months from the date of application.

Transfer in trademark application: After obtaining the Notice of Trademark Acceptance in trademark application, the transferee (buyer) shall bear the registration risk.

Transfer within the period of trademark announcement: the risk of transferring a registered trademark after trademark announcement is relatively lower than that in the application.

Trademark objection period transfer: If the trademark is objected during the trademark announcement period, we will give professional advice according to the possibility of objection, and the risk is lower than that during the announcement period.

Trademark transfer during the examination period: the risk of transfer after examination is less than that during the objection period.

(5) Time of transfer

The State Trademark Office will issue a Notice of Acceptance of Trademark Transfer Application to both the transferor and the transferee in about 3 months, and issue a Trademark Transfer Approval Certificate in about 10- 12 months.

Legal basis: Article 42 of the Trademark Law of People's Republic of China (PRC) assigns a registered trademark, the assignor and the assignee shall sign an assignment agreement and file an application with the Trademark Office. The transferee shall guarantee the quality of the goods using the registered trademark. After the transfer of a registered trademark is approved, it shall be announced. The transferee shall enjoy the exclusive right to use the trademark from the date of announcement.
