Article 3 The outdoor advertising facilities mentioned in these Regulations refer to facilities set up in various forms in external spaces such as buildings, structures, roads and various public places. , and used to publish commercial advertisements and public service advertisements.
Signboards as mentioned in these Regulations refer to indicator boards and plaques. State organs, organizations, enterprises, institutions, other organizations and individual industrial and commercial households shall set up marked names, shop names and signs in their offices, business premises or buildings.
Signboards with the functions of commodity promotion and service promotion, or signboards and plaques set outside offices and business premises, shall be governed by the Provisions on the Administration of Outdoor Advertising Facilities. Article 4 The establishment of outdoor advertising facilities shall conform to the special plan for the establishment of outdoor advertising facilities; The installation of signboards shall conform to the installation specifications of signboards.
The installation of outdoor advertising facilities and signboards should be compatible with the functions of regional planning, coordinated with the styles of buildings and structures and the surrounding environment, and meet the safety requirements. Article 5 The municipal and county people's governments shall strengthen the unified leadership over the management of outdoor advertising facilities and signboards within their respective administrative areas.
City management department is the management department of outdoor advertising facilities and signs in the city, which supervises, coordinates and guides the management of outdoor advertising facilities and signs within the administrative area of this county. County-level urban management departments are responsible for the management of outdoor advertising facilities and signs within their respective administrative areas.
Urban and rural planning, land, market supervision and management, transportation, highways, public security, safety supervision and management departments should do a good job in the management of outdoor advertising facilities and signs within their respective responsibilities.
The Town People's Government and sub-district offices are responsible for the daily management of outdoor advertising facilities and signs within their respective jurisdictions. Article 6 The administrative punishment and related administrative compulsory measures stipulated in these Regulations shall be implemented by the comprehensive law enforcement department of urban management in the area where comprehensive law enforcement of urban management is implemented. Seventh urban management departments should establish an information management platform for outdoor advertising facilities and signboards, and incorporate them into digital urban management, and announce the management information of outdoor advertising facilities and signboards to the public. Chapter II Management of Outdoor Advertising Facilities Article 8 The competent department of urban management shall, jointly with the competent department of urban and rural planning at the same level, organize the preparation of special plans for outdoor advertising facilities in urban areas and counties and submit them to the people's government at the same level for approval. The special planning of outdoor advertising facilities at the county level shall be reported to the municipal administrative department for the record.
Before the special planning of outdoor advertising facilities is submitted for examination and approval, the organization organ shall publish the draft planning according to law, and solicit the opinions of experts, the public and industry organizations through demonstration meetings, hearings or other means. The announcement time shall not be less than thirty days.
The approved special plan for outdoor advertising facilities shall be announced to the public for a long time in the outdoor advertising facilities and signboard information management platform to facilitate public inquiry and supervision. Article 9 The special plan for the establishment of outdoor advertising facilities approved according to law is the basis for the establishment and management of outdoor advertising facilities.
No unit or individual may adjust the special planning of outdoor advertising facilities without authorization; If adjustment is really necessary, it shall be re-submitted for approval in accordance with the original procedures. Tenth outdoor advertising facilities set up special planning should be in line with the overall urban planning and urban appearance standards, highlighting the characteristics of Jiangmen hometown of overseas Chinese, reflecting local culture.
The special planning of outdoor advertising facilities shall, according to the functional requirements of different areas of the city, delimit the forbidden areas, strictly controlled areas and exhibition areas of outdoor advertising facilities.
Outdoor advertising facilities shall not be set up in prohibited areas. In strictly controlled areas, the number, location, form and specifications of outdoor advertising facilities should be strictly controlled. Various outdoor advertising facilities can be set up in the exhibition area. Eleventh outdoor advertising facilities set up special planning should be clear about the following contents:
(a) the number, form, specific location and planning point of outdoor advertising facilities;
(two) the proportion and specific location of outdoor public service advertising facilities;
(three) the location of marking facilities;
(four) the specifications and materials of outdoor advertising facilities;
(five) road traffic safety, fire safety and environmental protection requirements of outdoor advertising facilities. Twelfth in any of the following circumstances, outdoor advertising facilities shall not be set up:
(a) the use or occlusion of municipal public facilities, traffic safety facilities, fire safety facilities, barrier-free facilities, hinder their normal use;
(two) the use of culverts, overpasses, overpass bridges, railway bridges, pedestrian bridges and vehicle tunnels;
(three) the use of dangerous buildings, illegal buildings and structures or damage to the structural safety of buildings and structures;
(four) within the scope of safety protection of river courses and flood control dikes;
(five) in all kinds of underground pipelines, overhead lines and other pipeline projects within the scope of protection;
(six) the use of street trees, green belts, hedges or damage to green space, affecting the green landscape;
(seven) the roofs and facades of residential buildings and commercial buildings that have not planned advertising space in the approved design plan;
(eight) in the state organs, people's organizations, schools, hospitals, cultural relics protection units, scenic spots and other construction control areas;
(nine) set in the red line of municipal roads, except for the outdoor advertisements attached to bus shelters and street sign light boxes;
(ten) other circumstances that need to prohibit the installation of outdoor advertising facilities.
