1. The trademark licensee must be a trademark applicant who meets the qualifications of the Trademark Law;
2. The trademark that can be used by others must be a registered trademark;
3. The trademark licensed for use by others should be consistent with the registered trademark;
4. The designated products of the trademark licensed for use by others shall not exceed the scope of goods and services approved by the trademark;
5 , The term of the trademark licensed to others shall not exceed the validity period of the registered trademark;
6. The licensee shall not license the trademark to others for further use without the authorization of the licensor;
7. The licensor shall supervise the quality of the licensee's products using the registered trademark; the licensee shall guarantee the products.
Article 43 of the Trademark Law of the People’s Republic of China: A trademark registrant may license others to use its registered trademark by signing a trademark license contract. The licensor shall supervise the quality of the goods used by the licensee using its registered trademark. The licensee shall ensure the quality of the goods using the registered trademark.
If you use someone else's registered trademark with permission, you must indicate the name of the licensee and the place of origin of the goods on the goods using the registered trademark.
When permitting others to use its registered trademark, the licensor shall submit its trademark use license to the Trademark Office for record, and the Trademark Office shall announce it. The trademark use license shall not be used against bona fide third parties without registration.
Article 7 of the "Trademark Law of the People's Republic of China" applies for registration and use of trademarks, and the principle of good faith should be followed.
Trademark users shall be responsible for the quality of the goods on which their trademarks are used. Industrial and commercial administrative departments at all levels should use trademark management to prevent behaviors that deceive consumers.
