A trademark assignment contract is an agreement signed by the assignor (owner) and the assignee of a registered trademark, in which the assignor assigns its registered trademark to the assignee and the rights and obligations of both parties are clarified.
according to article 42 of the trademark law and articles 31 and 32 of the regulations for the implementation of the trademark law:
1. Both parties are applicants.
2. In case of transfer due to other reasons such as inheritance, enterprise merger, merger or restructuring, the party accepting the exclusive right to use the registered trademark shall go through the transfer formalities of the registered trademark at the Trademark Office with relevant supporting documents or legal documents.
3. if the exclusive right to use a trademark is transferred according to the court's judgment, the transfer formalities shall also be handled.
the application for assignment/transfer/application for registered trademark is applicable to trademark assignment or transfer.
