What is the Civil Code?

Civil Code refers to the code used to regulate judicial relations between equal subjects in countries that adopt statutory law. The Civil Code regulates various legal behaviors and identity behaviors in the form of articles and abstract rules. Some civil codes will adopt customary law as a supplementary norm. In addition, most of them also provide for judicial autonomy between parties to make up for the shortcomings of various laws and regulations.

On May 28, 2020, the Third Session of the 13th National People's Congress voted to adopt the "People's Republic of China and the Civil Code." This law will come into effect on January 1, 2021.

The "Chinese Civil Code Draft (Proposed Draft)" was drafted by the Civil Code Legislation Research Team of the Chinese Academy of Social Sciences. The research team consists of the Institute of Law of the Chinese Academy of Social Sciences, the Law School of the Central University of Finance and Economics, Peking University Law School, Tsinghua University Law School, Renmin University of China Law School, Yantai University Law School, Fudan University Law School, Shandong University Law School, and Beijing University of Chemical Technology It is composed of 26 people from the Law School, University of International Business and Economics Law School, Shenzhen University Law School, China Construction Bank Group Legal Department and other units.

Liang Huixing, a member of the academic department, serves as the leader of the research team. The draft adopts the German Pandekton compilation style and is divided into seven parts: General Provisions, Property Rights, General Provisions of Creditor's Rights, Contracts, Torts, Relatives, and Inheritance, with a total of 1,947 articles.
