However, if the trademark cannot be renewed according to the law, the Trademark Office will make a rejection decision. If the Trademark Office refuses to accept the application for renewal of registration, it may, within 15 days from the date of receiving the notice of rejection, send an application for renewal review to the Trademark Review and Adjudication Board, attach the application for renewal of trademark registration and the original notice of rejection, and pay the review fee. Relevant trademarks must be legal before they can be handled in the process of enterprise use and operation. China Administration for Industry and Commerce and Trademark Review and Adjudication Board will investigate such trademarks and decide the follow-up procedures for such incidents. Trademark holders can also file an administrative lawsuit against the relevant results, and the competent department will manage them after raising objections.
