How to strengthen the supervision of market subjects in grass-roots industrial and commercial sub-bureaus under the new situation
The two fees of Changqiao Branch of wuzhong Administration for Industry and Commerce were suspended, and the new sanding scheme was introduced. Under the new situation, grass-roots industrial and commercial departments are facing functional transformation. How to perform their duties in place, improve the efficiency of supervision and serve the economic development is a problem worthy of consideration at present. The author believes that only by correctly positioning and finding the focus of work can the supervision efficiency be effectively improved. I. Functions of Grass-roots Industrial and Commercial Branches The Regulations on Industrial and Commercial Administration endows grass-roots industrial and commercial branches with nine supervisory and administrative functions, including subject registration and market supervision. Coupled with the relevant authorization from the administrative department for industry and commerce of the listing place and county (district), the functions and powers of the grass-roots industrial and commercial branches have been expanding. At present, the main responsibilities of grass-roots sub-bureaus are: to implement national laws, regulations, rules and policies; Perform related registration service functions; Supervise and manage all kinds of subjects within the jurisdiction, and investigate and deal with unlicensed business activities according to law; To assume the responsibility of standardizing and maintaining all kinds of market order according to law; Responsible for the supervision and management of commodity quality and food safety in the circulation field; Responsible for supervising and managing brokers, brokerage institutions and brokerage activities according to law; Implement contract administrative supervision and management according to law; Responsible for the supervision and management of advertising activities; Responsible for trademark management; Organize and guide the credit classification management of market entities; To undertake other tasks assigned by superiors and local governments. Faced with the increasing number of market players and the above-mentioned basic and daily affairs, as well as the bottleneck of aging age structure and low comprehensive quality in grass-roots sub-bureaus, the supervision status quo of being tired of coping and becoming a mere formality appears. In order to truly implement the supervision work and realize efficient and high-quality supervision, we must find the focus of the work. 2. Clear the focus of work, promote food safety, false advertising, unlicensed operation, counterfeiting, etc. Are the top priority related to the safety of people's production and life. Grass-roots industrial and commercial sub-bureaus stand in the front line of supervision and law enforcement. Every year, they should focus on solving the key and hot issues reflected by the society and the masses outside their daily work, adjust the supervision methods according to the characteristics of the objects of supervision and law enforcement, and ensure that their duties are in place. (1) food safety supervision: grass-roots industrial and commercial offices should establish a long-term supervision mode of "self-discipline+law enforcement". First, strengthen publicity and training, and guide operators to consciously implement systems such as claiming certificates and tickets, and checking incoming goods. Through the leading role of food safety demonstration stores, we will improve the self-discipline awareness of food operators and standardize their operations. Second, we must vigorously promote the level of information construction, establish the archives of food operators, especially to find out the basic situation of wholesalers and agents within our jurisdiction. By establishing a database, we can grasp the basic situation of food operators by classification and avoid pulling the net horizontally and vertically whenever there is a special inspection. The third is to intensify sampling inspection, give full play to the role of quick inspection and screening, form a three-linkage model of quick inspection+legal inspection+law enforcement, severely investigate and deal with unqualified food, and effectively ensure food safety in the circulation field. In addition, the author believes that food safety work can not rely solely on the industrial and commercial departments, but must be coordinated by quality inspection, health and other departments to make a good entrance for consumers. (2) Remediation of unlicensed operation: Stop the "two fees", reduce the operator's cost, and significantly improve the active license rate. At present, the biggest difficulty for the industrial and commercial departments to rectify unlicensed operation is the key industries involving pre-licensing. The Measures for Investigating and Banning Unlicensed Business clearly stipulates that the licensing examination and approval departments such as public security, land and resources, construction, culture, health, quality inspection, environmental protection, and drug supervision should also investigate and deal with them according to the duties entrusted by laws and regulations. However, there is a general illusion in society and local governments that it is a "housework" for the industrial and commercial departments to investigate and deal with unlicensed operations. Therefore, on the one hand, the industrial and commercial departments should strengthen social propaganda, actively communicate with the government, and try their best to reverse the illusion of this functional orientation. On the other hand, the industrial and commercial departments should give administrative guidance within the scope of their duties, ban unlicensed operation, manage the traces of unlicensed operation involving pre-licensing through daily inspection, improve the information copying system, and be investigated and dealt with by the relevant licensing examination and approval departments. The relevant information of plagiarists should be recorded in writing for future reference, so as to reduce the regulatory pressure and risk of the industrial and commercial departments. (3) Combating false advertisements: The bad social impact and consequences caused by false and illegal advertisements are well known. As the advertising supervision and management organ, the industrial and commercial departments are duty-bound to purify the market environment and protect the legitimate rights and interests of consumers. On the one hand, the industrial and commercial departments should highlight the key points of supervision, focusing on the advertisements of medical care, medicines and health foods that are directly related to the health and safety of the people, illegal and vulgar advertisements that endanger the physical and mental health of minors, and serious false and illegal advertisements that disrupt public order and affect social stability, and increase the intensity of rectification. On the other hand, it is necessary to strengthen administrative guidance to advertising operators and publishers, and urge them to establish and improve management systems such as advertising registration and certification document review. Moving the responsibility of censorship forward will help to better regulate advertising behavior. It is necessary to strengthen advertising monitoring, focus on online advertising, and improve monitoring and early warning capabilities. For those who have repeatedly published false and illegal advertisements and repeatedly punished repeated offenders, their advertising business shall be suspended according to law until their advertising qualification is cancelled. In addition to the above-mentioned key supervision work, the author believes that the improvement of cadres' quality is also a key issue. How to change from a "charging expert" to a "supervision expert" is a realistic problem before us. Law enforcement requires a deep legal foundation, and there is no room for a little ostentation. Only by paying close attention to education and training, training people of different classes, different cultural levels and different ages in different contents, updating professional knowledge in time, broadening knowledge and improving cadres' comprehensive ability and law enforcement quality can we actively respond to the new situation brought about by functional transformation and truly perform their duties in place.
