Legal analysis: The Market Supervision Administration is formed by the merger of the Industrial and Commercial Bureau, the Quality Supervision Bureau, the Food and Drug Administration and the Price Bureau. The Administration for Industry and Commerce is the government department in charge of market supervision and administrative law enforcement. In order to integrate market supervision resources, form a joint force of market supervision, strengthen food safety supervision and improve the level of market supervision, it is suggested that the market order management and anti-monopoly functions of the State Administration for Industry and Commerce, the General Administration of Quality Supervision, Inspection and Quarantine, the Food Supervision Department of the Food and Drug Administration, the the State Council Food Safety Office and the Ministry of Commerce be merged into the State Administration of Market Supervision. It is suggested not to retain the departments: State Administration for Industry and Commerce, State Administration of Quality Supervision, Inspection and Quarantine, and the State Council Food Safety Office. First, the Ministry of Health undertakes the comprehensive coordination, information release, monitoring and evaluation of food safety, and entrusts the handling of accidents to the State Administration of Market Supervision. Second, the former private economy supervision department of the State Administration for Industry and Commerce was renamed as the private economy development department and handed over to the Ministry of Commerce for management. Third, the Trademark Office and Trademark Review and Adjudication Board of the State Administration for Industry and Commerce will be handed over to China National Intellectual Property Administration for management.
