In trademark registration, the selection and protection of major categories, subcategories, and trade names

Article 29 of the "Trademark Law" stipulates: "Two or more trademark registration applicants apply for the same or similar trademarks on the same goods or similar goods. If it is registered, the trademark that was applied for first will be preliminarily reviewed and announced; if it is applied for on the same day, the trademark that was first used will be preliminarily reviewed and announced, and other people's applications will be rejected and will not be announced." It can be seen that the two concepts of the same product or similar products are very important. So, how to define these two concepts is generally as follows: 1. The same product refers to the same product. The same product refers to the product with the same name, purpose, function or sales channel. Generally speaking, the name of the same product should be the same, but sometimes two product names are different, but their essence is completely consistent, and they should be recognized as the same product, such as "noodles" and "flour". 2. Similar goods Similar goods refer to goods that are identical in terms of functions, uses, production departments, sales channels, consumer objects, etc., or that are generally believed by the relevant public to be specifically related and likely to cause confusion. To determine whether the goods are identical or similar, the general understanding of the goods by the relevant public shall prevail. At present, during the trademark registration process, the "Classification Table of Similar Goods and Services" published by the National Trademark Office is generally used as a reference for judgment. This book is divided into 45 categories based on the functions and uses of goods and services, and each category is divided into groups. Generally speaking, the goods or services in each group are similar to each other, and the groups are not similar to each other, but there are exceptions. For example: Category 05, Group 01 is medicines and other commodities, ***set up 8 segments. Although these 8 segments belong to the same group, they are different from each other; Category 02, Group 5 is paints , coatings and other products, the products in this group are similar to the 19 categories and 12 groups of architectural coatings. To sum up, it can be seen that the probability of successful application still exists, just in the Trademark Office’s mind.
