What is formal review? What does a formal review include?

Formal examination refers to the first procedure that the Trademark Office carries out after receiving the trademark registration application.

The content of the formal review includes:

1. Applicant qualification review. It mainly examines whether the applicant has the subject qualifications to apply for a registered trademark and whether the goods designated for protection by the applicant's trademark application comply with legal regulations;

2. Whether the foreign applicant has entrusted a trademark agency designated by my country. If a domestic applicant appoints an agent, whether the power of attorney meets the requirements;

3. Whether the filling in the application form complies with the regulations. Including whether the applicant's name, seal, and business license are consistent; whether the applicant's address is accurate; whether the goods or services designated by the applicant are standardized and specific, and whether the classification is accurate;

4. Trademark and trademark pattern Whether the specifications and quantity meet the requirements;

5. Whether the supporting documents to be submitted are complete and whether the fees are paid;

6. Review whether an application only declares one trademark ;

7. The date of application for examination of the trademark, the application number, and the date of application for trademark registration shall be based on the date of application documents received by the Trademark Office. If it is deemed through review that the application procedures are complete and the application documents are filled in in accordance with regulations, an application number will be assigned and a "Notice of Acceptance" will be issued.

If the application procedures are incomplete or the application documents are not filled in as required, the application will be returned and the application date will not be retained. The application procedures are basically complete or the application documents basically meet the regulations, but if they need to be supplemented or corrected, the applicant will be notified to make supplements and corrections. If the applicant makes corrections and returns them to the Trademark Office within the prescribed time limit, the application date will be retained. If a supplement or correction is requested but is not made or the supplement or correction exceeds the time limit, it will also be returned and the application date will not be retained.

The formal review is mainly divided into three parts: review of the application documents (whether the documents are complete, whether the filling is standardized, whether the signature/seal is missing), review of the trademark drawing specifications, clear procedures and necessary instructions, Classification review (review of the reported goods/services). Based on the results of the formal examination, the Trademark Office mainly issues three types of notices: "Notice of Acceptance", "Notice of Supplement and Correction" and "Notice of Rejection of Acceptance".

Article 21 of the "Regulations on the Implementation of the Trademark Law of the People's Republic of China" The Trademark Office shall examine the trademark registration applications accepted in accordance with the relevant provisions of the Trademark Law and these Regulations, and shall review the applications that comply with the provisions or If the registration application for the use of a trademark on some designated goods complies with the regulations, it will be preliminarily reviewed and announced; if the registration application does not meet the regulations or the registration application for the use of the trademark on some designated goods does not meet the regulations, it will be rejected or the application for the use of the trademark on some designated goods will be rejected. When applying for registration of a trademark, notify the applicant in writing and explain the reasons.
