In August 1997, "Guiyang Laoganma Flavor Food Co., Ltd." was officially listed. After the managers sent out by Tao Huabi came back one after another, they quickly put the company on the road to scientific management.
Because of her poor family, Tao Huabi has never read a day since she was a child. When she was 20 years old, she married a member of the 206 Geological Team; but within a few years, her husband died of illness and left her and their two children. In order to survive, she went to other places to work and run a street vendor.
In 1989, Tao Huabi used the little money she saved through frugality to build a house with bricks picked up from everywhere on a street in Longdongbao, Nanming District, Guiyang City. The humble restaurant, named "affordable restaurant", specializes in jelly and cold noodles. In order to accompany the meal, she specially made spicy sauce, specially used to mix the jelly, and the business was very prosperous. One morning, Tao Huabi felt dizzy after getting up, so she did not go to the vegetable market to buy peppers. Unexpectedly, when customers came to eat, they turned around and left when they heard that there was no spicy sauce. This incident touched Tao Huabi greatly. She immediately identified the potential of spicy sauce and started researching it with great concentration. After several years of repeated trial production, the spicy sauce produced by Tao Huabi has a more unique flavor. After eating the jelly, many customers bought some spicy sauce to take home. There were even some people who didn't eat jelly but came to buy her spicy sauce. Later, her jelly business became worse and worse, but the spicy sauce was not enough to sell no matter how much she made. One day at noon, after her spicy sauce was sold out, there were no customers eating jelly. She closed the shop door and visited more than 10 restaurants and food stalls selling jelly and found that their business was very good. It turned out that the spicy sauce these people used to make condiments was bought from her. The next day, she no longer sold spicy sauce alone. After a period of preparation, Tao Huabi gave up the restaurant she had been working on for many years. In July 1996, she rented two houses in Yunguan Village Committee, Nanming District, recruited 40 workers, and opened a food processing factory, specializing in the production of spicy food. Sauce, named "Laoganma Spicy Sauce". Although the output at the beginning of the factory was very low, local jelly shops still couldn't digest it. Tao Huabi personally carried the spicy sauce and sent it to various food stores and canteens of various units for trial sales. Within a week, those test sellers called her and asked her to double the delivery; she sent her employees to double the delivery, and soon they were out of stock
Since 1997, fake "Lao Ganma" There are as many as fifty or sixty kinds of products, and the counterfeiting areas are all over Guizhou, Hunan, Sichuan, Shaanxi, Gansu and other places. Lao Ganma was once forced to a critical moment of life and death. The company dispatched batches of anti-counterfeiting personnel. She was too busy with the holiday to eat, so she bought two steamed buns and mixed them with her own black bean sauce and chili. Counterfeiters are hiding everywhere. In order to find evidence, they have to go out to investigate even in the middle of the night. Among all the counterfeiters, the "Laoganma" produced by Hunan Huayue Food Company is the most "confident". This is because they have a "legal" registered trademark. From 1996 to 1998, Lao Ganma applied to the Trademark Office of the State Administration for Industry and Commerce for trademark registration many times.
However, they were all rejected on the grounds that "'Ganma' is a common personal appellation, so the use of Lao Ganma as a trademark lacks distinctive features." Tao Huabi's avatar has been replaced by the old lady's avatar of "Liu Xiangqiu", and the manufacturers are Tangmeng Food Factory and Huayue Company. The rest of the decoration and packaging, and even the words "Lao Ganma" specially inscribed by Lao Ganma Company, are all intact. Fudou did not copy the design of the authentic "Lao Gan Ma", but his first application for trademark registration in 1998 was successful. After that, Guizhou Lao Gan Ma "uncomfortably" also obtained a registered trademark. The marathon lawsuit continued until March 20, 2001. The Beijing Higher People's Court finally ruled that Huayue Food Co., Ltd. should stop using the "Lao Gan Ma" trade name on flavored black bean products and stop using the name "Lao Gan Ma" in connection with Guiyang's "Lao Gan Ma" The company produced bottle stickers similar to the "Lao Gan Ma" flavored black bean paste, compensated the Guiyang "Lao Gan Ma" company for economic losses of 400,000 yuan, and apologized to the Guiyang "Lao Gan Ma" company in a nationally circulated newspaper. More than two years after the final judgment, the State Trademark Office ruled on May 21, 2003: "Laoganma" was first used by the Guiyang "Laoganma" company in the flavored food produced by it, and the registration of the Guiyang "Laoganma" company was approved. The "Lao Gan Ma" trademark was rejected, and Huayue Company's application to register the "Lao Gan Ma" trademark was rejected. Cancel the trademark "Liu Xiangqiu Laoganma and Pictures" registered by Huayue Food Company. This lawsuit has caused quite a stir in the economic and legal circles. Together with Wang Meng and other six major writers' copyright cases against Century Internet, Peking University Founder's "trap evidence collection" case, and the Olympic five-ring symbol case, it is also called the Beijing High Court. Intellectual property classic cases of the decade.
When Tao Huabi was running an affordable hotel, Jiang Xingheng, then the mayor of Nanming District, learned that she was encountering difficulties in her business and made a special trip to "visit her privately." At the door of the hotel, Jiang Xingheng said to Tao Huabi: "Laoganma, you can develop with peace of mind. If you have any difficulties, we will help you." Tao Huabi didn't know who the visitor was, and thought the other person was a "vegetable farmer", so she asked strangely: "Who are you?" Help me carry it, or help me carry it." During the development of Laoganma Company, governments at all levels in Guizhou Province have given strong support. From the concern of the leaders of Guizhou Province to the leaders of Nanming District of Guiyang City, they personally went to the front line of combating counterfeiting with company personnel. With its own efforts and the support of the government, Laoganma Company has become another brand in Guizhou Province after "Kweichow Moutai", "Huangguoshu" and "Guizhou Magic". According to statistics, as a key national leading enterprise in agricultural industrialization, the company has established 280,000 acres of pollution-free pepper bases in 7 counties in Guizhou Province, forming an industrial chain that extends from the fields to the global market. As "Lao Gan Ma" became famous, other provinces and cities continued to invite her to set up factories in other places for development and offered a large number of preferential policies, but Tao Huabi refused. She said: Children and grandchildren must stay in Guizhou to develop, become bigger and stronger in Guizhou, and bring glory to Guizhou.
