In real life, it often happens that couriers are unwilling to deliver goods to their homes. In this regard, the new regulations stipulate that enterprises engaged in express delivery business should deliver the express mail to the agreed delivery address, the recipient or the agent designated by the recipient, and inform the recipient or agent to accept it in person. The consignee or agent has the right to face-to-face acceptance.
This means that it is against the relevant regulations that the courier refuses to deliver the goods to your door. If the courier wants to put the courier in the community collection point or courier cabinet, he needs to get the consent of the recipient first.
The identity information is not true, so you can't send it by express.
The real-name registration system of express delivery was officially implemented at the end of 20 15, but in practice, there are still many cases where the real-name registration system is ignored. The Provisional Regulations on Express Delivery further clarified the real-name registration system.
The new regulations require that enterprises engaged in express delivery business should check the identity of the sender and register their identity information when receiving and sending express mail. If the sender refuses to provide identity information or provides false identity information, the enterprise engaged in express delivery business shall not accept and send it.
However, it is also clear that the express waybill shall not record user identity information other than name, address and contact number.
The maximum fine for leaking user information is 654.38+10,000 yuan.
The express real-name registration system not only ensures the safety of express parcels, but also raises people's concerns about information leakage.
In this regard, the new regulations stipulate that no unit or individual may illegally inspect other people's express mail except for the inspection by relevant departments according to law. No unit or individual may open, conceal, destroy or resell other people's express mail without permission.
Enterprises engaged in express delivery business and their employees shall not sell, disclose or illegally provide user information known in the process of express delivery service. In case of violation of relevant regulations, the penalties are as follows:
The postal administration department shall order it to make corrections, confiscate its illegal income and impose a fine of more than 50,000 yuan 1 10,000 yuan; If the circumstances are serious, a fine of not less than 50,000 yuan but not more than 6,543.8+10,000 yuan shall be imposed, and it may be ordered to suspend business for rectification until its express business license is revoked.
How to claim for courier damage?
The new regulations strengthen the operating norms of express mail handling, guide enterprises to take effective measures to ensure the safe operation of express mail, and require "no landing, no throwing" to prevent "barbaric operation".
At the same time, the enterprise and the sender are required to determine the liability for compensation according to the agreed insured rules, and the enterprise is required to inform the insured rules before the sender fills in the waybill, allowing the enterprise to require the sender to insure the valuables.
If the courier is damaged in the process of sending, it is stipulated that the user can claim compensation from the enterprise to which the trademark, brand name and courier waybill belong, or from the enterprise that actually provides the service.
