Can trademarks continue to be used in the examination of invalidation?
When a trademark is declared invalid, it may not continue to be used. When a registered trademark is declared invalid, its exclusive right to use the trademark shall be regarded as nonexistent from the beginning, but the decision or ruling declaring the registered trademark invalid shall not have retrospective effect. The decision or ruling that a registered trademark is invalid has no retrospective effect on the following matters before the invalidation: 1, the judgment, ruling and conciliation statement of trademark infringement cases made and executed by the people's court; 2. Trademark infringement cases that have been made and executed by the administrative department for industry and commerce; 3. The trademark transfer contract that has been performed; 4. The trademark license contract that has been fulfilled. The decision or ruling declaring a registered trademark invalid has no effect on the above four categories of matters. If it has been executed, it may not be required to restore the original state on the grounds that the registered trademark is declared invalid. However, if losses are caused to others due to the malice of the trademark registrant, compensation shall be made.
