The Henan Provincial Market Supervision and Administration Bureau is a newly established unit under the Henan Provincial Institutional Reform in 2018. It is an agency directly under the Henan Provincial People's Government, at the department level, and bears the brand name of the Henan Provincial Intellectual Property Office. On November 29, 2018, the newly established Henan Provincial Market Supervision and Administration Bureau was officially launched.
The main responsibilities of the Henan Provincial Market Supervision and Administration Bureau are:
(1) Responsible for the comprehensive supervision and management of the province’s market. Organize the implementation of national laws and policies related to market supervision and management, draft local laws and regulations related to market supervision and management, formulate relevant policies and standards, and organize the implementation of the quality-strengthening province strategy, food safety strategy, standardization strategy, and intellectual property strategy. Formulate and organize the implementation of relevant plans, standardize and maintain market order, and create a market environment of honesty, trustworthiness, and fair competition.
(2) Responsible for the unified registration of market entities across the province. Organize and guide the registration of market entities such as various enterprises, farmers' professional cooperatives, units engaged in business activities, individual industrial and commercial households, and permanent representative offices of foreign (regional) enterprises throughout the province. Establish an information disclosure and sharing mechanism for market entities, disclose and share relevant information in accordance with the law, strengthen credit supervision, and promote the construction of a credit system for market entities.
(3) Responsible for organizing and guiding the comprehensive law enforcement of market supervision in the province. Guide the construction of a comprehensive law enforcement team for market supervision across the province. Organize the investigation and handling of major and complex cases and coordinate cross-regional law enforcement work. Standardize the administrative law enforcement behavior of market supervision in the province.
(4) Responsible for unified anti-monopoly law enforcement across the province. Coordinate and promote the implementation of competition policies and guide the implementation of the fair competition review system. Undertake relevant anti-monopoly law enforcement work according to authorization.
(5) Responsible for supervising and managing market order. Supervise and manage market transactions, online commodity transactions and related services in accordance with the law. Organize and guide the investigation and punishment of unfair competition, illegal direct selling, pyramid schemes, infringement of trademarks, patents and intellectual property rights, and the production and sale of counterfeit and shoddy products. Organize and guide price supervision and inspection work across the province. Guide the development of the province's advertising industry and supervise and manage advertising activities. Guide the investigation and punishment of unlicensed production and operation and related unlicensed production and operation activities. Formulate specific measures to protect consumer rights across the province and guide the Henan Consumers Association in carrying out consumer rights protection work.
(6) Responsible for the province’s macro quality management. Develop and implement institutional measures for quality development. Coordinate the construction and application of quality infrastructure across the province. Work with relevant departments to organize and implement the quality supervision system for major engineering equipment, organize investigations into major product quality accidents, establish and uniformly implement a recall system for defective products, and supervise and manage product anti-counterfeiting work.
(7) Responsible for the supervision and management of product quality and safety in the province. Organize and implement product quality and safety risk monitoring and supervisory spot inspections. Organize and implement the quality classification system and quality and safety traceability system. Responsible for the province's industrial product production license management. Responsible for the province's fiber quality supervision.
(8) Responsible for the safety supervision and management of special equipment in the province. Comprehensively manage the safety inspection and supervision of special equipment, supervise and inspect the implementation of energy-saving standards for high-energy-consuming special equipment and boiler environmental protection standards. Organize and guide special equipment safety accident investigations.
(9) Responsible for the comprehensive coordination of food safety supervision and management in the province. Organize the formulation of provincial food safety policies and measures and organize their implementation. Responsible for the construction of the food safety emergency system, organizing and guiding the emergency response, investigation and handling of major food safety incidents. Establish and improve a direct reporting system for important food safety information.
(10) Responsible for the supervision and management of food safety in the province. Establish a supervision and inspection system and a hidden danger investigation and management mechanism covering the entire process of food production, circulation, and consumption in the province and organize their implementation to prevent regional and systemic food safety risks. Promote the establishment of a mechanism for food producers and operators to implement their main responsibilities, and guide enterprises to establish and improve food safety traceability systems. Organize and carry out food and related product safety supervision and sampling, risk monitoring, verification and disposal, risk warning, and risk communication across the province. Organize and implement the province's special food registration-related work, filing and supervision and management work.
(11) Responsible for the unified management of the province’s measurement work. Promote legal units of measurement and the national measurement system, and manage measuring instruments and value transfer and comparison. Standardize and supervise commodity volume and market measurement behaviors.
(12) Responsible for the unified management of the province's standardization work. Organize and implement standardized laws and regulations. Responsible for the formulation of local standards organizations in accordance with the law. Coordinate, guide and supervise the formulation of local standards, group standards and enterprise standards in accordance with the law. Manage the province's commodity barcoding work.
(13) Responsible for the unified management of inspection and testing work in the province. Formulate the province's inspection and testing work system and organize its implementation, promote the reform of inspection and testing institutions, standardize the inspection and testing market, improve the inspection and testing system, and guide and coordinate the development of the inspection and testing industry.
(14) Responsible for the unified management, supervision and comprehensive coordination of the province’s certification and accreditation work. Organize and implement a unified national certification, accreditation and conformity assessment supervision and management system.
(15) Responsible for the supervision, management, protection and application of intellectual property rights in the province. Formulate and implement policies and plans for the creation, protection, use and trading operations of intellectual property. Establish and improve the intellectual property protection system and public service system, guide trademark and patent enforcement, protect intellectual property rights, and promote the creation and application of intellectual property rights.
(16) Responsible for market supervision and management technology and information construction, news publicity, external exchanges and cooperation. Undertake work related to technical trade measures as required.
(17) Responsible for promoting the development of the province's non-public economy, guiding and coordinating the province's market supervision and management system to carry out party building work for small and micro enterprises, individual industrial and commercial households, and professional markets.
(18) Manage the Henan Provincial Food and Drug Administration.
(19) Complete other tasks assigned by the Provincial Party Committee and Provincial Government.
