Monaco is a member of the World Intellectual Property Organization, and has also joined international treaties and conventions such as the Madrid Agreement on the International Registration of Trademarks, the Paris Convention, and the Nice Agreement. Monaco is a member of the CTM of the European Community and a member of the Madrid Agreement. Trademarks are based on the first-to-file principle. Trademarks are passed by the Intellectual Property Tribunal, the Directorate of Economic Expansion, the Department of Finance and Economic Distribution. The trademark is valid for 10 years and is renewable for a further period of 10 years.

The acquisition of Monaco trademark rights is based on the principle of use, and the prior user has the right to register and exclusive ownership. The classification of goods and services adopts the international classification. Applications can be made for multiple categories, but more than three categories will require additional fees.
