Is Apple's mobile phone appearance patent really infringing? Who won the Apple Appearance Patent Infringement Case?
The website of Beijing Intellectual Property Office stated on May 19 that it ruled that iPhone 6 and iPhone 6 Plus infringed Shenzhen Bailey's appearance patent, which did not attract media attention. At the beginning of June, Apple filed an administrative reconsideration with the Beijing Intellectual Property Court, and finally pushed Apple to the forefront again. This lawsuit should have started at the beginning of 20 15, because Shenzhen Boli applied for the design patent of 100C smart phone on 20 14+0, and was granted the patent in July of that year. In March of 20 15, Apple applied to our bureau to cancel the patent, but our bureau maintained the patent in February of 20 15. Not many people may know about Shenzhen Boli, but many people may know about 100% mobile phones in Shenzhen, because this company was invested by Baidu in 10/20165438, but this company is now on the verge of bankruptcy. It is said that Shenzhen Boli sued Apple for poor management, which was a year ago. Some time ago, due to the dispute with Shanghai and Germany, Apple was sued at the beginning of 20 15. Some people may think that Shenzhen Boli is blackmailing Apple. In fact, compared with the appearance patent filed by Poli 20 14 in September, it is not surprising that Beijing Intellectual Property Court ruled that Apple infringed. After all, Boli's patent application was released six months earlier than iPhone 6, and during this period, it also experienced an invalid review of Apple's patent application. I believe that Beijing Intellectual Property Office has sufficient legal basis. After the invalidation of the patent and the first-instance judgment, it is even more difficult for Apple to make a comeback, because the Beijing Intellectual Property Court must have considered the possible consequences before making such a bold punishment, and it is impossible to give Apple a chance to make a comeback. Well guessed, the final result must be reconciliation, because Apple will not tolerate the ban on iPhone 6 in Beijing, and will not tolerate the nationwide ban. Once Apple's administrative reconsideration is unsuccessful, reconciliation is the only channel. If we go deeper, we can't help but combine it with the Sino-US trade disputes in recent years. In the first half of this year, the United States imposed export restrictions on ZTE on the grounds of selling prohibited products to Iran and other countries (which have been temporarily lifted), and recently began to review Huawei. It is not impossible for China to use legal weapons to impose potential legal sanctions on Apple. If this is the case, even if Apple wants to reconcile with Shenzhen Boli, it will not be so easy. It's still early, and there won't be any results in the short term. Wait and see.
