1. Summary
1 Afghanistan’s current Trademark Law came into effect on September 20, 1960.
2. The trademark right is obtained based on the mixed principle of registration and use, that is, the trademark right is granted to the person who first files for registration, but the prior user of the trademark can file a request for registration within 3 years after the trademark is registered. 3. Product trademarks, service marks and certification marks can be applied for registration in Afghanistan.
4. Goods are divided into 36 categories. Categories 1-34 adopt the Nice International Classification Standard. Category 35 includes all services. Category 36 includes all goods not included in other categories.
5. Afghanistan has not joined the major international treaties or agreements on trademarks.
