2. WeChat platform-if it is not handled in time, it shall be jointly and severally liable for the fault compensation liability of malicious cybersquatters or electronic signature certification institutions in WeChat official accounts.
According to the provisions of the second and third paragraphs of Article 36 of the Tort Liability Law, "If a network user uses a network service to commit an infringement, the infringed party has the right to notify the network service provider to take necessary measures such as deleting, blocking and disconnecting the link. If the network service provider fails to take necessary measures in time after receiving the notice, it shall be jointly and severally liable with the network users for the enlarged part of the damage. If the network service provider knows that network users use their network services to infringe upon the civil rights and interests of others and fails to take necessary measures, it shall bear joint liability with the network users. " Therefore, if WeChat platform fails to deal with the malicious cybersquatting behavior of WeChat WeChat official account in time, the obligee may claim that WeChat platform shall be jointly and severally liable for the above compensation.
The "WeChat Public Platform Authentication Service Agreement" gives the above-mentioned "WeChat authentication" to merchants and individuals. The agreement also stipulates the authentication institution, that is, Tencent will audit and authenticate itself or entrust a third-party audit institution according to the materials and information submitted by users. In the process of authentication of official WeChat account, the holder of official WeChat account suffered losses due to malicious cybersquatting of official WeChat account, and WeChat platform, as an electronic authentication service provider, cannot prove his innocence, so he shall be liable for compensation according to the provisions of the Electronic Signature Law.
Third, third-party independent electronic certification service institutions-bear joint and several liability for fault presumption.
The obligee signed the above-mentioned WeChat public platform authentication service agreement with Tencent, and Tencent entrusted its electronic authentication service to a third-party independent electronic authentication service organization. Because it chose to sue for infringement, the third-party independent electronic certification service organization should bear joint and several liability for its electronic certification service.
