When a bank handles a credit card for an individual, it should fulfill the obligation of examination, including whether the ID card is for personal use, the authenticity of the ID card and so on. If the identity card is stolen by others, the credit card is successfully handled in the bank, and the bank fails to fulfill its review obligation, it shall bear the main responsibility for the consequences. Banks should bear corresponding tort liability for personal bad credit records caused by negligence in auditing. The infringed person can ask the bank to stop the infringement and restore his personal reputation, and can ask for certain mental compensation, but the indirect losses caused by bad records are not within the scope of the bank's responsibility. Banks are responsible for overdrafts caused by fraudulent use of credit cards, and even credit stains are recorded. There is no need for customers to repay, and banks are also obliged to cancel bad credit records.
Legal basis: Article 17 of the Law of the People's Republic of China on Resident Identity Cards commits one of the following acts, and the public security organ shall impose a fine of more than 200 yuan but less than 1,000 yuan, or detain it for less than 10 days. If there are illegal gains, the illegal gains shall be confiscated: (1) fraudulently using other people's identity cards or using fraudulent identity cards; (2) buying, selling or using forged or altered identity cards.
