Credit cards that are two months overdue will not be prosecuted.
Overdue credit card means that the credit card user fails to repay the loan on the repayment date specified by the bank.
Credit cards that are overdue for two months will not be prosecuted. Most banks will not prosecute users until they are three months overdue. If a credit card has not been repaid by the repayment date, it is considered overdue and will be recorded in the credit report. Any bad records after overdue will be recorded in the personal credit record. If the cardholder fails to repay the loan, he or she will be placed on the bank's blacklist, which will affect the cardholder's credit score and affect future loans and other businesses. To determine whether the cardholder intends to possess illegally, the cardholder’s credit record, repayment ability and willingness, status of applying for and overdrafting the credit card, purpose of overdraft funds, performance after overdraft, and reasons for failure to repay as required should be considered. Wait for the situation to make a judgment. If you maliciously overdraw your credit card, you are suspected of credit card fraud.
Solutions for overdue credit cards
1. When a credit card is overdue, the bank will usually call for collection. We must actively cooperate with the bank and pay attention to answering the bank's collection call. If you are temporarily unable to repay, you should explain the situation to the bank and express your willingness to repay to see if you can apply for a deferment of repayment. If the bank agrees to the negotiation, then the repayment will be as agreed upon after the negotiation.
2. You can repay the minimum repayment first. As long as the user has repayment behavior, the bank can avoid considering it as a malicious overdraft. If the user has repayment behavior, the bank will not easily prosecute overdue users.
3. You can find a way to repay the working capital in one go. Overdue credit cards will incur interest charges. One day of overdue will result in one day of interest. You can first borrow money from relatives and friends to repay the debt. Clear it and avoid accruing interest.
Legal Basis
Article 196 of the Criminal Law of the People's Republic of China and the People's Republic of China: Under any of the following circumstances, if the amount of credit card fraud is relatively large, the person shall be punished Whoever commits a crime shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and shall also be fined not less than 20,000 yuan but not more than 200,000 yuan; if the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than 10 years, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan. The following fines shall be imposed; if the amount is particularly huge or there are other particularly serious circumstances, the sentence shall be not less than 10 years in prison or life imprisonment, and a fine of not less than 50,000 yuan but not more than 500,000 yuan, or property confiscation:
(1) Using a forged credit card, or using a credit card fraudulently obtained with false identification;
(2) Using an expired credit card;
(3) Pretending to use another person’s credit card;
(4) Malicious overdraft. The term "malicious overdraft" as mentioned in the preceding paragraph refers to the cardholder's behavior of overdrafting beyond the prescribed limit or within the prescribed period for the purpose of illegal possession and failing to return the card after being called upon by the card-issuing bank. Anyone who steals a credit card and uses it shall be convicted and punished in accordance with the provisions of Article 264 of this Law.
