Legal analysis: when the credit card is overdue, there will not only be a late payment fee of 5% of the minimum unpaid part, but also a full penalty interest on the bill (the daily interest rate is 0.5 ‰, and the interest will be collected from the day of consumption until the principal and interest are paid off), and there will be a bad credit record in the Credit Information Center of China People's Bank, so it is difficult to apply for credit cards and bank loans within five years; If the payment is overdue for more than three months or the bank reminds you twice, the bank will freeze the card and list it as a prohibited customer (blacklist). Legal basis: Article 196 of the Criminal Law of People's Republic of China (PRC) commits credit card fraud under any of the following circumstances. (a) using a forged credit card, or using a credit card fraudulently obtained with a false identity certificate;

(2) Using an invalid credit card;

(3) Fraudulent use of another person's credit card;

(4) malicious overdraft.

The term "malicious overdraft" as mentioned in the preceding paragraph refers to the behavior that the cardholder overdraws beyond the prescribed limit or time limit for the purpose of illegal possession, and refuses to return it after being urged by the issuing bank.

Whoever steals a credit card and uses it shall be convicted and punished in accordance with the provisions of Article 264 of this Law.
