2. If the bank refuses to negotiate and puts forward unreasonable negotiation requirements, you can go to the CBRC. It is suggested to lodge a complaint in written form, list the unreasonable behavior of the bank in detail, and attach relevant evidence, and mail it to the Banking Insurance Supervision Branch where the credit card headquarters is located, requesting the Banking Insurance Supervision Branch to intervene and coordinate, and urging the bank to solve the cardholder's debt problem by stages through consultation. It should be noted that even if the banking regulatory bureau intervenes, it will not directly interfere with the negotiation results, but will urge banks and users to negotiate and handle them. Whether an agreement can be reached in the end depends on the approval results of the bank. According to the regulations, if the user is willing to repay, but unable to repay, he can negotiate with the bank on an equal footing and negotiate a new repayment plan, which can be divided into 60 installments at the longest.
1. How did you negotiate with the bank when the credit card was overdue? If the repayment can be made normally, no one wants to be disturbed by collection every day. Not only is his credit damaged, but he also bears mental and economic pressure, which really makes the debtor cry and say that it makes no difference. Moreover, once the expectation appears, banks will generally ask for full repayment, so the repayment pressure of liabilities will be even greater, and it will not be paid for a while. At this time, many people choose to negotiate with the bank to repay their debts. It is difficult for banks to agree to repay their debts by installments, and it is completely impossible to apply for a foreclosure period, but they must master the ways and means:
1) Have a correct attitude. If you want to reach a second installment with the bank, you must correct your attitude itself. Have a real willingness to repay, and put forward a time limit acceptable to yourself and the bank according to your repayment ability;
2) Grasp the negotiation time and take the initiative. If you want to negotiate with the bank after the credit card is overdue, you must grasp the negotiation time, preferably within three months after it is overdue, because it is the internal collection of the bank within three months, and the third party has not yet collected it. The internal collection of banks is still relatively mild;
3) Seeking truth from facts. When the bank negotiates, it must explain the real reason for the overdue, say where the money in the light truck has gone, and provide corresponding proof if necessary. Fourth, seek help, because it is very difficult for individuals to negotiate with banks, then banks also need to bear certain repayment risks, and individuals and cardholders negotiate to bear certain handling fees. However, if it is negotiated through legal channels, after sorting out all the debts of the debtor, a scientific repayment plan and method are given and solved through legal channels. According to Article 70 of the Measures for the Supervision and Administration of Credit Cards of Commercial Banks, we have reached a personalized repayment plan with banks to avoid the increase of interest penalty and avoid prosecution. 1 Pay it back slowly in five years. This way can completely avoid prosecution and collection, provided that each installment can be repaid on time through negotiation.
