Legal analysis: To illegally hold other people’s credit cards, the perpetrator objectively carried out the act of holding. The holding here is a continuous state, and is not limited to the actor hiding the card on himself, hiding it at home or other places, entrusting others to keep it for safekeeping, etc., the holding can be established. No matter where the object is placed, as long as the actor has actual control over it or can freely dispose of it. At the same time, the illegality of illegally holding other people's credit cards should be accurately determined. Illegal possession includes at least two situations: illegal source and legal source but illegal possession.
Legal basis: Article 177 of the Criminal Law of the People's Republic of China and the People's Republic of China. Illegal possession of other people's credit cards in large quantities shall constitute the crime of obstructing credit card management. The crime has the following forms of behavior: (1) Holding and transporting credit cards knowingly that they are counterfeit, or holding and transporting blank credit cards knowing that they are counterfeit and in large quantities; (2) Illegally holding other people’s credit cards in large quantities; Larger; (3) Using false identity certificates to fraudulently obtain credit cards; (4) Selling, purchasing, or providing others with forged credit cards or fraudulently obtaining credit cards with false identity certificates.
