After the credit card is overdue, he will take the initiative to negotiate with the bank, apply for personalized repayment and provide proof of inability to repay. The bank will think it appropriate.
202 1 year new rules for overdue repayment of credit cards
1, liquidated damages. In the new regulation of 202 1 credit card overdue, the bank changed the "late payment fee" generated by credit card overdue into "liquidated damages". Many cardholders don't understand the difference between late payment and liquidated damages. The liquidated damages will roll more and more with the overdue amount of the bill, that is, the interest will roll. There is a fixed limit for late payment fees, which cannot exceed 5% of the minimum repayment amount.
2, credit card overdue sentencing standards. 202 1 in the new overdue clause of the civil code, the sentencing standard for credit card filing is raised from the original 1 10,000 yuan to 50,000 yuan. In other words, if the cardholder owes a credit card bill of no more than 50,000 yuan, there is a high probability that he does not need to bear criminal responsibility, that is, he is unlikely to go to jail. 3. Minimum repayment amount. In the past, when the cardholder could not repay the credit card bill at one time, he could choose to repay it in installments or choose the minimum repayment amount as 10% of the bill amount. Now, if the cardholder can't repay the minimum repayment amount of 10%, he can also negotiate with the bank to lower the monthly repayment amount. But the cardholder's credit is relatively good, otherwise it is difficult for the bank to agree.
In addition to the above provisions, if the cardholder's credit card is overdue for more than 3 months, he can negotiate with the bank for up to 60 personalized interest-free periods.
