Can credit cards be preserved?

Legal analysis: As long as the credit card is property related to the case or is within the scope of application for preservation, the people's court can seal or freeze the credit card.

Legal basis: "Civil Procedure Law of the People's Republic of China"

Article 101: Due to urgent circumstances, interested persons who do not apply for preservation immediately will lose their rights. If the legitimate rights and interests are irreparably damaged, the person may apply for preservation measures to the people's court where the property to be preserved is located, where the respondent is domiciled, or has jurisdiction over the case before filing a lawsuit or applying for arbitration. The applicant shall provide a guarantee. If the applicant fails to provide a guarantee, the application shall be rejected.

After accepting the application, the people's court must make a ruling within 48 hours; if it decides to take preservation measures, it must start implementation immediately.

If the applicant fails to file a lawsuit or apply for arbitration in accordance with the law within thirty days after the People's Court takes preservation measures, the People's Court shall terminate the preservation.

Article 102: Preservation shall be limited to the scope of the request or the property related to the case.
