The penalties for using other people's credit card loans are as follows:

1. Borrowing credit cards from others is more than 1 10,000 yuan but less than 1 10,000 yuan. If the amount is relatively large, he shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and shall also be fined not less than 20,000 yuan but not more than 200,000 yuan;

2. If the amount is more than 6,543,800 yuan but less than 6,543,800 yuan, and the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan;

3. If the amount is more than 6,543,800 yuan, especially huge, or there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan, or his property shall be confiscated.

The credit card was stolen by others as follows:

1, report the loss. No matter how you find your credit card stolen, the first step is to call the bank to report the loss immediately;

2. Check the money at the ATM. You don't need to replenish your card after reporting the loss, but go to the nearest ATM to check your credit card balance. At the same time, it is also the most favorable evidence to prove that it is stuck on you and where you are. The bank can retrieve the inquiry records and videos, which can prove that you were not at the crime scene and the card was on you.

3. Ask the bank to give important documents. Find a place with a fax machine, dial the phone again with the fax machine, and ask the customer service to fax two important documents: Explanation of Accounting Inquiry and Supplementary Explanation of Non-personal Transaction;

4. Report to the police station.

If one of the following circumstances constitutes the crime of credit card fraud or theft, and the amount is relatively large, he shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and shall also be fined not less than 20,000 yuan but not more than 200,000 yuan; If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan; If the amount is especially huge or there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan or confiscated property:

(a) using a forged credit card, or using a credit card fraudulently obtained with a false identity certificate;

(2) Using an invalid credit card;

(3) Fraudulent use of another person's credit card;

(4) malicious overdraft.

The term "malicious overdraft" as mentioned in the preceding paragraph refers to the behavior that the cardholder overdraws beyond the prescribed limit or time limit for the purpose of illegal possession, and refuses to return it after being urged by the issuing bank.

Whoever steals a credit card and uses it shall be convicted and punished in accordance with the provisions of Article 264 of this Law.
