If you owe a credit card and don't sue in the bank, you may not go to jail, which depends on the specific situation. If the credit card is not repaid at maturity, it is a breach of contract in civil law, and the debtor should bear the corresponding liability for breach of contract according to the terms of use of the credit card. Under normal circumstances: if the credit card is overdrawn with malicious intent for more than 1, yuan, and the cardholder takes illegal possession for the purpose, and fails to return it after being collected twice by the issuing bank for more than 3 months, criminal responsibility shall be investigated for credit card fraud. In any of the following circumstances, it shall be deemed as "for the purpose of illegal possession" as stipulated in the second paragraph of Article 196 of the Criminal Law: (1) knowing that there is no repayment ability and a large amount of overdraft cannot be returned; (two) wantonly squandering overdraft funds, unable to return; (3) Escaping after overdraft, changing contact information and evading bank collection; (4) Evading or transferring funds, concealing property and evading repayment; (five) the use of overdraft funds for illegal and criminal activities; (six) other acts of illegal possession of funds and refusal to return them.
