Then there is only one situation left, that is, I am still young, but I am very ill and may die at any time. If you really want to treat a disease or have other ideas, you may make crazy cash withdrawals with your credit card or overdraw a lot of money before you die. So what will the bank do in this case?
In fact, it is impossible for credit card holders to cash out crazily and exceed the credit limit. Generally speaking, the credit limit of ordinary people's credit cards will not exceed 200,000. Then there are two principles for banks to solve the problem of cardholders' arrears. One principle is, if you can find a way, try to recover the principal and interest. One principle is to evaluate whether it is cost-effective to draw a clear line between the time and labor costs that need to be reinvested if the arrears need to be recovered and the possibility of recovering the principal and interest of the arrears. Banks are also profit-oriented enterprises, so they always calculate economic accounts. Banks are undoubtedly the kind of enterprises that can calculate economic accounts best.
So in this case, basically we can know that banks may take the following measures.
1. If the credit card overdraft debt is not large after the customer dies, then basically the bank will forgive the debt after knowing the situation and obtaining the cardholder's death certificate, which means there will be no further collection and no more demand. That is to say, when people die, their debts are gone.
2. If the credit card overdraft debt is relatively large after the death of the customer, the bank will negotiate with the family members and try to settle the debt with an appropriate amount. If no agreement can be reached, the bank will consider it in the following order.
There are some assets in the customer's home, which means that the family of the deceased may get the inheritance. At this time, the bank will file a lawsuit and ask the family to repay the debt. Then family members, as heirs of the estate, do have the responsibility to repay. Of course, the repayment amount is limited to the inherited amount, and there is no need to repay the excess.
4. If the customer has no assets at home, such as the cardholder's death due to a serious illness, and the assets at home are heavily in debt for medical treatment, then the bank will actually take legal action, because it is actually difficult to get by with such a large amount of internal exemption, but it will reach an agreement with the family during the court mediation to settle this large debt with a sum of money shared by both parties.
In fact, even if the bank finds out that the customer's overdraft was obtained by cashing out, because the cardholder has passed away, the bank will not pursue it again, and it is enough to achieve the effect of collecting money economically. We should remember that in China, people die a fair death, so most of the time it's the same. If possible, both parties shall settle it through consultation.
