How long will it take before credit cards come to collect debts?

If you are overdue for more than three months or have not repaid the bank reminder twice or more: debt collection agencies may come to your door.

The bank will send you text messages, emails, and phone calls when the cardholder fails to repay the money in the second month. In the third month, it became a debt collection agency to collect payment.

If you don’t have the money to pay back the full amount, then pay back the minimum payment. If you can’t even pay the minimum, pay back a little bit. This will buy you an extra month. If you can find the money in the extra month and pay off the entire debt, the bank won't come looking for you.

If you are overdue for more than three months or have not paid back more than two bank reminders:

The bank will freeze your card and list you as a prohibited customer (blacklist) , and will also sue you for credit card fraud and malicious overdraft, and the court will enforce it. If you refuse to repay after prosecution and the amount owed exceeds RMB 10,000, the court will impose a sentence based on the crime of credit card fraud in Article 196 of the Criminal Law:

Article 196 of the Criminal Law stipulates that under one of the following circumstances, credit card fraud is committed If the amount is huge or there are other serious circumstances, the sentence is to be not less than five years but not more than 10 years of fixed-term imprisonment or criminal detention, and a fine of not less than 20,000 yuan but not more than 200,000 yuan; If the amount is particularly huge or there are other particularly serious circumstances, the sentence shall be not less than 10 years in prison or life imprisonment, and a fine of not less than 50,000 yuan but not more than 500,000 yuan, or property confiscation:

(1) Using a forged credit card, or using a credit card fraudulently obtained with false identification;

(2) Using an expired credit card;

( 3) Fraudulent use of other people’s credit cards;

(4) Malicious overdraft.

A malicious overdraft refers to the cardholder's behavior of overdrafting beyond the prescribed limit or within the prescribed period for the purpose of illegal possession, and still refuses to return the card after being called upon by the card-issuing bank. Malicious overdrafts are a major form of risk in the credit card business and are part of credit card fraud.
