Chapter I General Provisions
Article 1 In order to adapt to the development of credit card business and provide comprehensive and high-quality services to cardholders, these Articles of Association are formulated in accordance with relevant national laws, regulations and other rules and regulations.
Article 2 The credit card of China Merchants Bank (hereinafter referred to as the "credit card") is a credit payment tool issued by China Merchants Bank (hereinafter referred to as the "issuing bank") to the public, which gives cardholders a certain credit limit within which they can spend first and then repay, and has the functions of consumer credit, cash deposit and withdrawal, transfer and settlement, etc.
Article 3 Credit cards are divided into personal cards and business cards according to different card issuers, among which personal cards are divided into main cards and supplementary cards; According to different credit grades, it is divided into platinum card, gold card and ordinary card; According to different currencies, it is divided into single-currency cards (including RMB cards and single-currency international cards) and dual-currency cards. Credit cards will use the logo of UnionPay, Visa, MasterCard, JCB or other bank card organizations.
Article 4 Card issuers, cardholders and guarantors shall abide by these Articles of Association.
Article 5 Some terms involved in the Articles of Association are defined as follows:
"Cardholder" refers to the applicant who applies for a personal card from the card issuer and obtains a card, including the cardholder of the main card and the cardholder of the supplementary card; Or refers to the cardholder authorized by the person in charge of the legal person or other organization after the legal person or other organization applies to the card issuer and obtains the card. Credit cards are only used by the cardholder himself.
"Credit limit" refers to the maximum credit limit approved by the card issuer according to the applicant's credit status and used by the cardholder within the validity period of the card, including fixed limit, temporary limit and special limit.
"Transaction day" refers to the date when the cardholder actually uses the card to spend money, deposit and withdraw cash, transfer transactions or actually has transactions with relevant institutions.
"Bank bookkeeping date" refers to the date when the card issuer records the transaction amount in the cardholder's credit card account or records the fees and interests. Transfer to the cardholder's credit card account as required.
"Bookkeeping date" refers to the date when the card issuer collects the accumulated outstanding consumer transaction principal, cash withdrawal transaction principal, fees, etc. Calculate the interest and the amount payable by the cardholder.
"Due repayment date" refers to the latest date when the cardholder should repay all the payable amount or the minimum repayment amount stipulated by the card issuer.
"Repayment date" refers to the date when the cardholder actually repays the arrears to the card issuer.
"All amount payable" refers to the sum of accumulated transaction principal, interest and expenses that have been recorded by the cardholder but have not been repaid as of the current billing date.
The "minimum repayment amount" refers to the minimum amount that the cardholder should repay as stipulated by the card issuer, including a certain proportion of the accumulated unpaid principal of consumer transactions and the principal of cash withdrawal transactions, all expenses, interest, the amount owed beyond the credit limit, and the sum of the unpaid part of the minimum repayment amount last month.
"Interest-free repayment period" refers to the period during which the cardholder can enjoy interest-free treatment from the bank bookkeeping date to the due repayment date of consumer transactions on the premise that all the payables are repaid before the due repayment date (inclusive).
"Over-limit fee" refers to the fee that the cardholder should pay to the card issuer in accordance with the regulations when the accumulated outstanding transaction amount exceeds the credit limit approved by the card issuer.
"Late payment fee" refers to the fee that the cardholder should pay to the card issuer in accordance with the regulations when the repayment amount is lower than the minimum repayment amount before the due repayment date (inclusive).
Chapter II Application
Article 6 China residents and compatriots from Hong Kong, Macao and Taiwan who have reached the age of 18, have full capacity for civil conduct and good credit standing may apply for personal credit card master cards from card issuers with valid identity documents. Personal cardholders can also apply for supplementary cards for other natural persons with full civil capacity or natural persons with limited civil capacity. The main cardholder can apply for cancellation of the supplementary card at any time.
The vice cardholder and the main cardholder share the same credit line, and the main cardholder can set the usage limit of the vice card within the credit line; All the transaction funds of the supplementary card and the corresponding interest and expenses are credited to the account of the main card, and the cardholder of the main card is fully liable for the debts incurred under the main card and the supplementary card; Supplementary card holders with full capacity for civil conduct and main card holders are jointly and severally liable for the debts incurred under the main card and supplementary card, while supplementary card holders with limited capacity for civil conduct are only liable for the debts incurred under the supplementary card they hold. The supplementary card holder may apply for cancellation of the supplementary card after paying off all debts of the supplementary card.
Article 7 Enterprises, administrative institutions, social organizations and other economic organizations authorized by legal persons who open basic deposit account in domestic financial institutions may apply for a business card to the card issuer with the supporting documents such as the basic deposit account account opening permit issued by the People's Bank of China (foreign exchange settlement account is required for applying for an international business card). The qualification of the cardholder of the unit card shall be designated and revoked in writing by the legal representative of the unit or its authorized person. The applicant shall bear all debts arising from the unit card.
Article 8 When applying for a credit card, an applicant shall fill in the application form and submit relevant supporting documents correctly, completely and truthfully in accordance with the provisions of the card issuing institution, and agree that the card issuing institution may inquire about the credit status of the applicant from any relevant department, unit or individual, and keep and use relevant materials.
Article 9 According to the credit status of the applicant, the card issuing institution decides whether to issue the card, whether to require the applicant to provide the guarantee and the guarantee method, and determines the way and type of the card obtained by the applicant, the credit line granted to the applicant, etc. Failed application materials will not be returned.
Article 10 The guarantee methods provided by the applicant include: guarantee, mortgage and pledge. A corresponding guarantee contract shall be signed separately for the guarantee. The scope of protection covers all debts incurred by the cardholder under his credit card (including principal and interest, over-limit fees, late fees and recourse fees for overdrafts within and outside the credit line).
Article 11 After receiving a credit card, the cardholder shall immediately sign the same signature as the application form in the signature column on the back of the credit card, and use the same signature when using the credit card for transactions, otherwise the cardholder shall be responsible for the losses caused thereby. Card issuers also provide cardholders with inquiry passwords and transaction passwords (that is, cash advance passwords and credit card consumption passwords) through designated channels.
Chapter III Use
Article 12 Cardholders can use UnionPay, Visa, MasterCard, JCB or other bank cards to organize acceptance marks abroad, or use their credit cards for spending by special merchants with UnionPay acceptance marks and other special merchants designated by card issuers in China; Withdraw local currency cash at overseas cash withdrawal outlets or ATMs with acceptance marks of UnionPay, Visa, MasterCard, JCB or other bank card organizations; Withdraw RMB cash from ATMs with UnionPay acceptance marks in China or cash withdrawal outlets designated by card issuers or ATMs, and enjoy other services provided by card issuers. Corporate cards cannot be used to withdraw cash in China.
Article 13 When a cardholder uses Visa, MasterCard and JCB acceptance marks for consumption abroad, he only needs to sign the same signature on the shopping receipt as the signature column on the back of the card; When a special merchant with UnionPay acceptance logo spends money overseas or in China, the cardholder must enter the password according to the agreement with the card issuer in advance, and sign the same signature as the signature column on the back of the card on the purchase order, unless otherwise agreed by the cardholder and the card issuer.
When the cardholder withdraws cash online at the domestic and foreign bank outlets designated by the card issuer, he only needs to enter the cash advance password; To withdraw cash at the counter of domestic bank outlets, you must enter the cash advance password and sign the same signature on the withdrawal slip as the signature column on the back of the card; You must sign your name and show your identity documents when you spend money in China or withdraw money at domestic bank outlets; To withdraw cash at the counter of overseas bank outlets, you must sign and show your identity documents as required.
Article 14 All transactions conducted by password are regarded as the cardholder's own behavior, and the card issuer handles various transactions such as deposit and withdrawal, transfer and settlement for the cardholder according to the password and other electronic information, and the electronic information records generated by the transaction are all valid vouchers for the transaction. If a transaction is conducted without a password, the transaction voucher signed by the cardholder and other supporting documents agreed between the card issuer and the cardholder are valid vouchers for completing the transaction, unless otherwise agreed between the cardholder and the card issuer. Cardholders should use credit cards on the Internet in a safe technical and commercial environment, otherwise, cardholders should bear all risks and losses caused by using credit cards on the Internet.
Fifteenth cardholders in domestic consumption, cash withdrawal and use of other self-service equipment, must abide by the relevant laws and regulations of the state, as well as the relevant provisions of UnionPay, card issuers and acquiring banks; In consumption abroad, cash withdrawal should be handled in accordance with the relevant regulations of bank card organizations such as UnionPay, Visa, MasterCard and JCB and the acquiring bank. The limit for cardholders to withdraw cash at home and abroad shall be implemented in accordance with relevant national laws and regulations.
Article 16 A credit card is valid for a maximum of 3 years, and will automatically become invalid when it expires. However, the outstanding creditor-debtor relationship arising from the cardholder's use of the credit card shall not be terminated due to the invalidation of the card. If the cardholder is unwilling to get a new card upon expiration, he shall notify the card issuer in writing or in other forms recognized by both parties at least 1 month before the expiration of the card validity period. Otherwise, the card issuer will think that the cardholder voluntarily replaces the new card and can decide whether to give the cardholder a new card without telling the cardholder.
Seventeenth cardholders need to modify or reset the password, should apply for changing the password in the way specified by the card issuer. When the credit card is damaged, the cardholder shall change the card in other ways stipulated by the card issuer or agreed by both parties.
Article 18 When a credit card is lost, stolen or occupied by others, the cardholder shall promptly report the loss through the customer service hotline of the issuing bank. Card issuers should report losses in the computer system to help prevent losses. The report of telephone loss will take effect after it is confirmed by the card issuer, and all economic losses incurred before the report of loss takes effect shall be borne by the cardholder (the applicant of the company card), unless otherwise agreed between the cardholder and the card issuer. When the cardholder colludes with others, maliciously colludes or has other dishonest behaviors, or fails to cooperate with the card issuer to investigate the situation, all losses will be borne by the cardholder, and the card issuer will not bear any responsibility.
Chapter IV Interest Calculation, Repayment and Account Management
Article 19 For credit card transactions, transactions settled in RMB, the transaction amount, corresponding handling fees and interest are credited to RMB accounts; For transactions settled in foreign currency, the transaction amount, corresponding expenses and interest shall be credited to the foreign currency account.
Article 20 If the cardholder repays all the payable funds before the due repayment date (inclusive), the consumer transactions incurred in the current period on the current bill shall enjoy interest-free treatment from the bank bookkeeping date to the due repayment date. Unless otherwise agreed in the company card, the longest interest-free repayment period is 50 days, but the longest interest-free repayment period shall not exceed the longest interest-free repayment period required by relevant legal documents.
Article 21 The cardholder may repay the loan according to the minimum repayment amount stipulated by the card issuer. If the cardholder fails to repay in full before the due repayment date (inclusive), he will not enjoy the interest-free repayment period. The card issuer will calculate interest on the transaction funds that the cardholder does not meet the interest-free conditions from the bank bookkeeping date, and the daily interest rate will be 0.5 ‰, with compound interest on a monthly basis. If there is any change, it shall be implemented according to the relevant provisions of the People's Bank of China.
Article 22 If the cardholder fails to pay off the minimum repayment amount before the due repayment date, in addition to paying overdraft interest according to the above-mentioned interest-bearing method, he shall also pay a monthly fine of 5% for the unpaid part of the minimum repayment amount;
Article 23 When the cardholder exceeds the credit limit, in addition to paying overdraft interest according to the above-mentioned interest calculation method, he shall also pay 5% monthly overrun fee for the part exceeding the credit limit.
Twenty-fourth card issuers do not pay interest on the deposits in the cardholder's credit card account.
Twenty-fifth personal card holders to repay foreign exchange arrears, they must hold or purchase foreign currency cash in accordance with the provisions, or deposit cash or transfer deposits from their foreign exchange accounts; To repay RMB arrears, it must be deposited in cash or transferred from a bank account.
Twenty-sixth unit card holders to repay foreign exchange arrears, must be transferred from their foreign exchange settlement accounts; To repay RMB arrears, you need to transfer deposits from basic deposit account.
Article 27 If the cardholder of personal card or business card chooses the agreed automatic repayment method, the card issuer will deduct the corresponding amount from the designated deposit account opened in the card issuer on the due repayment date to repay the credit card arrears.
Article 28 The card issuer shall repay the cardholder in the order of billed and unbilled, and the billed part shall be paid off one by one according to the order of annual fee, interest, expenses, cash advance or transfer transaction principal and consumption transaction principal.
Article 29 If the principal cardholder or cardholder no longer uses the credit card within the validity period or after the expiration of the validity period, he shall apply to the card issuer for account cancellation, and the card issuer shall handle the formal account cancellation procedures for him within 45 days after accepting the application for account cancellation (except for the card that has expired for more than 45 days). When the cardholder applies for account cancellation, he should return the credit card to the card issuer, or destroy the card according to the regulations of the card issuer, and the card issuer will not refund the annual fee received; In case of overpayment when the company card is cancelled, the funds in the RMB account of the company card will be transferred to its basic deposit account, and the funds in the foreign currency account of the company card will be transferred to the corresponding foreign exchange account. No cash withdrawal or withdrawal is allowed. Before closing the account, the cardholder shall pay off the overdraft principal and interest and expenses. After going through the cancellation procedures, the cardholder still needs to pay off all outstanding debts of the cancelled credit card.
Article 30 The card issuer may require the cardholder to pledge a certain amount of deposit, and then grant the cardholder a credit line. Without the consent of the card issuer, the pledged deposit of the cardholder shall not be withdrawn within 45 days after the credit card is pledged and cancelled. When the cardholder fails to pay off his credit card debt on time, the card issuer has the right to deduct the pledged deposit of the cardholder at any time to pay off his debt.
Chapter V Rights and Obligations of Card Issuers
Article 31 The rights of card issuers:
(a) the right to review the applicant's credit status, the right to verify the applicant's relevant information with any interested party, the right to request, save and use the applicant's personal data, the right to decide whether to issue a card to the applicant, the right not to return the unapproved application materials, and the right to approve and adjust the credit limit of the cardholder.
(2) When the cardholder fails to repay the loan beyond the due repayment date, the card issuer has the right to collect the debt, pursue it according to law and stop using the cardholder's card.
(3) For cardholders who do not comply with relevant laws and regulations, China Merchants Bank credit card regulations, etc. The card issuer has the right to cancel the cardholder's qualification and stop using the cardholder's card without prior notice, and may authorize the personnel of relevant units to withdraw their credit cards.
(4) Have the right to require IC credit card holders to abide by the relevant regulations of the card issuer on the card.
(5) If the cardholder violates the relevant provisions of the Articles of Association and causes losses to the bank, the card issuer has the right to apply for legal protection and investigate the legal responsibilities of the cardholder or related parties according to law.
(six) the credit card is owned by the card issuer, and the card issuer reserves the right to withdraw or not to issue the card; After issuing the notice, regardless of whether the cardholder receives or knows it, the issuing bank has the right to suspend the cardholder's right to use the credit card or reduce the cardholder's credit limit at any time for reasons it considers justified, or cancel the cardholder's use of the credit card for reasons it considers justified, or put the credit card on the stop payment list.
(7) If the cardholder can't use the card due to power supply, communication and other reasons, the card issuer has the obligation to assist the cardholder to solve the problem or provide necessary help as appropriate, but it is not responsible for the losses that may be caused to the cardholder.
(8) Card issuers have the right to charge certain fees to cardholders and charge them into their credit card accounts. The charging items and standards are detailed in the annex.
Article 32 Obligations of card issuers:
(a) to provide the applicant with information on the use of credit cards, including contracts, specifications, charging standards and interest calculation methods.
(two) to give a reply to the cardholder's inquiry about the account.
(3) Providing monthly settlement service for cardholders in the way agreed by both parties; However, if there is no transaction since last month's bill and there is no outstanding balance in the account, or the card issuer and the cardholder have other agreements, the statement may not be provided to the cardholder.
(4) The card issuer shall keep the credit information of the cardholder confidential, except as otherwise provided by laws, regulations and financial supervision institutions, or authorized by the cardholder, or when the card issuer is in special circumstances such as collection and debt recourse.
Chapter VI Rights and Obligations of Cardholders
Article 33 The rights of cardholders:
(a) the cardholder shall enjoy the services promised by the card issuer to the credit card, and shall have the right to supervise the service quality and complain that the service is not up to standard.
(2) Applicants and cardholders have the right to know the functions, usage methods, charging items, charging standards, applicable interest rates and related calculation formulas of credit cards.
(3) The cardholder has the right to ask the card issuer for the statement of the last 3 months free of charge.
(4) Within the time limit stipulated by laws and regulations and payment and clearing institutions, the cardholder has the right to apply to the card issuer for assistance in reading the purchase order. If the investigation results prove that the transaction is indeed done by the cardholder, the relevant expenses shall be borne by the cardholder.
(5) After the loss report comes into effect, the cardholder will not bear the economic losses caused by the forgery or misappropriation of his credit card, except that the state organ deducts the funds in the card according to law.
Article 34 Obligations of cardholders:
(1) The applicant shall provide true and effective information to the card issuer. If the card issuer deems it necessary, the applicant shall provide the qualified letter of guarantee and other relevant materials to the card issuer.
(2) If the work of the cardholder or guarantor changes, the mailing address and telephone number, ID number, organization name, etc. , you should go to the card issuer or contact the card issuer to handle the data change procedures in time. Otherwise, the card issuer will not bear any responsibility for the losses caused by this.
(3) The cardholder shall properly keep his inquiry password and transaction password (i.e. cash advance password and credit card consumption password). Losses caused by improper password keeping shall be borne by the cardholder.
(4) The cardholder shall repay the overdraft principal, interest, annual fee, handling fee, over-limit fee, late payment fee and other expenses on time according to the contract with the card issuer, and shall not refuse to pay the money owed to the card issuer on the grounds of disputes with merchants or other third parties. If the credit card documents are incorrect or incomplete, but it is confirmed that the transaction exists and the amount is correct, the cardholder shall not refuse to pay the transaction amount.
(5) The cardholder shall properly keep the transaction voucher after using the card to prevent the card information from being stolen by others. Cardholders should pay attention to checking the statement. If you fail to receive the statement on time, you should check with the card issuer in time. The cardholder shall not refuse to pay the arrears (including the corresponding fees and interests, etc.) to the card issuer. The reason is that he hasn't received the bill yet.
(6) If the card issuer increases the credit limit of the cardholder due to the cardholder's good transaction and repayment records, and the cardholder is unwilling to increase the credit limit, it shall require the card issuer to restore its original credit limit, but the cardholder shall be responsible for paying off the transaction amount and the corresponding interest and expenses.
(seven) the cardholder shall properly keep the card and report the loss in time; The credit card is only for the cardholder's own use, and all consequences arising from renting, transferring or lending the credit card shall be borne by the cardholder himself.
(eight) in order to prevent risks and protect the interests of the issuing bank and the cardholder, the cardholder shall cooperate with the issuing bank and the special merchants to complete the risk prevention operation.
Chapter VII Supplementary Provisions
Article 35 Matters not covered in the Articles of Association shall be implemented in accordance with relevant national laws, regulations and rules. Unless otherwise agreed by the card issuer and the cardholder, both parties shall abide by the agreement. If the cardholder's card transaction involves overseas institutions, the relevant disputes shall be handled in accordance with the regulations of bank card organizations such as UnionPay, Visa, MasterCard and JCB.
Article 36 The card issuer reserves the right to amend the Articles of Association in accordance with national laws and regulations. The amendment or adjustment of the Articles of Association will take effect after the card issuer reports to the China Banking Regulatory Commission for the record and publication, without further notice. The revised terms are equally binding on all parties.
Article 37 The Articles of Association shall be formulated and interpreted by the card issuer, and shall come into force after being filed by China Banking Regulatory Commission, and the credit card articles of China Merchants Bank shall be abolished at the same time.
