If the credit card is overdue, the court will accept it. If the arrears are returned in time, even if the bank has filed a lawsuit and the customer returns the arrears, the bank can withdraw the lawsuit. If the arrears are not repaid, the court will also decide to return the credit card arrears. Therefore, timely repayment is better. If you are temporarily unable to repay, you can negotiate with the bank to repay by installments or extend the repayment period.

Article 119 of the Civil Procedure Law: Conditions for prosecution A prosecution must meet the following conditions:

(1) The plaintiff is a citizen, legal person and other organization that has a direct interest in the case;

(2) Having a clear defendant;

(3) Having specific requests, facts and reasons;

(4) It falls within the scope of civil litigation accepted by the people's court and is under the jurisdiction of the sued people's court.
