Credit card litigation process:

1, the bank informed the cardholder to repay, and the defendant refused to repay;

2. The bank formally sues, and then the cardholder will receive a summons;

3. The summons can be sent to the cardholder's home or work unit;

4. Then the cardholder will appear in court on the day of the trial, and then the court will judge the cardholder to pay back the money and formally inform the cardholder of the consequences of not paying back the money;

5. If you insist on not paying back, the bank will apply for enforcement and confiscate the cardholder's finance;

6. If the cardholder still refuses to pay back, he shall bear criminal responsibility.

Credit card litigation materials:

1, the original defendant's identity certificate, that is, a copy of the cardholder's ID card and a copy of the business license of the bank or issuing bank;

2. Account opening agreement, if not, provide a copy of the credit card;

3. Account details that can reflect the transactions involved;

4. Report receipt;

5. Check the record or the certificate issued by the police station that Kaka was on the cardholder when reporting the case;

6. ATM transaction receipt after the card is stolen.

Legal basis: Article 1 19 of the Civil Procedure Law of People's Republic of China (PRC).

Forcible summons, fines and detention must be approved by the President.

A subpoena should be issued.

Fines and detention shall be decided in writing. If you are not satisfied, you may apply to the people's court at the next higher level for reconsideration once. Execution shall not be suspended during reconsideration.
