Is the credit card a personal debt or a husband-and-wife debt?
1. Is the credit card a personal debt or a couple's debt?

1. Whether the credit card is a personal debt or a husband-and-wife debt needs to be determined according to the actual situation. They are:

(1) In general, credit cards are handled by husband and wife in their own names for personal use, and generally belong to personal debts;

(2) When the court determines that the credit card debt is the joint debt of husband and wife, it mainly considers whether the credit card consumption is mainly used for family life. If it is used for family life, it shall be recognized as joint and several debts.

2. Legal basis: Article 1062 of the Civil Code of People's Republic of China (PRC).

The following property acquired by husband and wife during the marriage relationship shall be jointly owned by husband and wife:

1, salary and bonus;

2. Income from production and operation;

3. Intellectual property income;

4. Inheritance or gift of property;

5. Other properties that should be shared.

Second, how to convert unilateral debt into joint debt of husband and wife

1, the transformation of unilateral debt before marriage. If the unilateral debts of men and women before marriage are recognized and accepted by the other party at the same time because of the establishment of marriage relationship, and both parties actively repay them together after marriage, and both parties have been married for a long time without raising any objection, in this case, the unilateral debts before marriage can be treated as joint debts of husband and wife;

2. Houses or other properties owned by individuals before marriage have been used, operated and managed by both parties for a long time because they have been married for many years, and the labor costs paid by both husband and wife have infiltrated into the property. In this case, unilateral property can be transformed into joint property of husband and wife. Then, according to the principle of consistency of laws and rights and obligations in our country, personal debts before marriage are borrowed for the establishment of husband and wife's common life, and consumed for the purchase of common necessities. The articles and houses after marriage are also shared by husband and wife, and the resulting unilateral debts should also be regarded as husband and wife's common debts;

3. The husband and wife are separated or one of them has been working outside for a long time, and the other is in separate debt for family life. For example, if the husband doesn't return from work, and the woman borrows money alone to pay tuition for her children at home, whether the other party knows it or not, it should be treated as a joint debt of husband and wife;

4. Debts arising from one of the men and women going abroad and unilaterally accepting gifts from outsiders to their families. For example, if a given car has an accident, the resulting debt should be regarded as a joint debt of husband and wife.
