3. How long can overdue records of personal credit information be eliminated?
1. If you have any objection, you can apply to the central bank for cancellation of the wrong record. If the information entered in the personal credit report is incorrect, you can go to the local central bank to apply for cancellation, which can generally be solved within ten working days after the application is accepted;
2. The second option is to wait for the bad records to be automatically eliminated. If you have a bad record of personal credit investigation caused by overdue credit card before, you will pay off the debt after five years, and the bad record will be automatically eliminated. There are two types of overdue credit records. If the credit card is overdue, its overdue record will be kept for two years or more.
3. If it is a bad credit report, it will not be eliminated within five years. It is stipulated that the banking system should update the personal credit information database once a month, generally not exceeding the interval of two months. The information that can be found in personal credit records is 1 2 months ago. If there are overdue records, the query time of credit information depends on the update time of each bank.
(1) The central bank will record the repayment information for 24 months in the credit information system. If there is a record of overdue repayment, it will be recorded in personal credit information. It is suggested that the cardholder continue to use it for more than two years after paying off the overdue amount, and make records to eliminate the overdue record of credit investigation.
(2) According to the regulations of the central bank on credit management, loan credit records shall be kept for 5 years from the date of termination, and shall be cleared after 5 years.

Article 196 Whoever commits credit card fraud under any of the following circumstances, if the amount is relatively large, shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and shall also be fined not less than 20,000 yuan but not more than 200,000 yuan; If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan; If the amount is especially huge or there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan or confiscated property:
(a) using a forged credit card, or using a credit card fraudulently obtained with a false identity certificate;
(2) Using an invalid credit card;
(3) Fraudulent use of another person's credit card;
(4) malicious overdraft.
The term "malicious overdraft" as mentioned in the preceding paragraph refers to the behavior that the cardholder overdraws beyond the prescribed limit or time limit for the purpose of illegal possession, and refuses to return it after being urged by the issuing bank.
Whoever steals a credit card and uses it shall be convicted and punished in accordance with the provisions of Article 264 of this Law.
