Can couples borrow credit cards?

Yes. It is legal to give your credit card to others for use with the cardholder's consent. It is illegal only to swipe a credit card without the cardholder's consent or to steal the cardholder's credit card and use it to swipe the card. And if a husband and wife borrow a credit card due to family ties and live together, it is a joint debt of the couple and must be repaid jointly by both parties.

Legal Basis

According to Article 1064 of the Civil Code that took effect on January 1, 2021

Both husband and wife have the same consent Debts borne by mutual consent such as signature or subsequent ratification by one spouse, as well as debts borne by one spouse in his or her own name for the daily needs of the family during the marriage, are joint debts of the spouses.

Debts borne by one spouse in his or her own name during the marriage, which exceed the daily needs of the family, are not joint debts of the couple; however, the creditor can prove that the debt is used for the joint purpose of the couple. Exceptions include life, sex, production and operation, or based on the consent of both spouses.
