Article 79 of the "Criminal Procedure Law of the People's Republic of China" for criminal suspects and defendants who have evidence to prove the facts of the crime and may be sentenced to a penalty of imprisonment or more, it is not enough to obtain bail pending trial. In order to prevent the occurrence of the following social dangers, arrests shall be made:

(1) Those who may commit new crimes;

(2) Those who endanger national security and public security Or there is an actual danger to social order;

If criminal suspects or defendants who are released on bail pending trial or under residential surveillance violate the regulations on release on bail pending trial or under residential surveillance, and the circumstances are serious, they may be arrested.

Article 196 of the Criminal Law of the People's Republic of China and the People's Republic of China: Any person who commits the crime of credit card fraud or theft under any of the following circumstances and conducts credit card fraud activities with a relatively large amount shall be sentenced to a prison sentence of not more than five years Fixed-term imprisonment or criminal detention, and a fine of not less than 20,000 yuan but not more than 200,000 yuan; if the amount is huge or there are other serious circumstances, the sentence is not less than five years but not more than 10 years of fixed-term imprisonment, and a fine of not less than 50,000 yuan but not more than 500,000 yuan; If the amount is particularly huge or there are other particularly serious circumstances, the person shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan, or have property confiscated:

(2) Using an expired credit card;

(3) Pretending to use another person’s credit card;

(4) Malicious overdraft.

The term "malicious overdraft" as mentioned in the preceding paragraph refers to the cardholder's behavior of overdrafting beyond the prescribed limit or within the prescribed period for the purpose of illegal possession and failing to return the card after being called upon by the card-issuing bank.

Whoever steals a credit card and uses it shall be convicted and punished in accordance with the provisions of Article 264 of this Law. ”
