(1) From June, 5438 to February, 2009, the Supreme Law "Interpretation on Several Issues Concerning the Specific Application of Laws in Handling Criminal Cases of Impairment of Credit Card Management" stipulated that "in violation of state regulations, cash is paid directly to credit card holders by means of fictitious transactions, false pricing, cash return, etc., and if the circumstances are serious, it shall be punished as the crime of illegal business in accordance with the provisions of Article 225 of the Criminal Law.

(2) The so-called serious circumstances refer to the overdue repayment of cash of more than 6,543,800 yuan, or the economic loss of financial institutions of more than 6,543,800 yuan. If the cash amount is more than 5 million yuan, or the funds of financial institutions are overdue by more than 6.5438+0 million yuan, or the funds of financial institutions are overdue by more than 6.5438+0 million yuan, it shall be deemed as "the circumstances are particularly serious" and punished by more than 5 years.
