The credit card is overdue because after using the credit card, we failed to repay the arrears arising from using the credit card within the specified date. The overdue credit card has a serious impact on us. If it is not handled well, it will probably bring us unnecessary trouble and worry us.
Usually, after our credit cards are overdue, most banks will provide time tolerance repayment and tolerance services for the credit cards in the hands of cardholders. In other words, under certain circumstances, banks allow credit card holders not to repay their loans within a certain period of time. As long as the cardholder can call the issuing bank to apply for time and pay off the arrears in full within the limited period after the repayment date stipulated by the bank, the overdue phenomenon of the cardholder will not be entered into the personal credit information system.
In fact, the law of overdue credit cards is clearly stipulated, and the impact on credit information is only the smallest aspect. Generally speaking, overdue credit cards will bring serious consequences to individuals:
The first is fines and penalty interest.
Late payment of credit cards will result in late fees and interest. The overdue fine is 5% of the unpaid part of the minimum repayment amount, and the minimum repayment amount is RMB 10 yuan or USD 1 yuan. Interest means that all consumption in the current period is charged from the bookkeeping date (usually the day after consumption), and the daily interest rate is five ten thousandths until it is fully paid off. It can be seen that the overdue credit card is not cost-effective for individuals, and the economic punishment is very heavy.
Secondly, violating the criminal law may lead to imprisonment. Article 196 of the Criminal Law stipulates that in any of the following circumstances, if a large amount of credit card fraud is committed, it shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and a fine of not less than 20,000 yuan but not more than 200,000 yuan shall be imposed; If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan; If the amount is especially huge or there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan or confiscated property:
(a) using a forged credit card, or using a credit card fraudulently obtained with a false identity certificate;
(2) Using an invalid credit card;
(3) Fraudulent use of another person's credit card;
(4) malicious overdraft.
