Credit black account:
Credit black households generally refer to people whose credit cards are seriously overdue or whose loans are seriously overdue, because such people are blacklisted by banks. The credit report reflects that the applicant has a serious bad record, the applicant's willingness or ability to perform the debt is seriously flawed, and the previous debt has formed a factual risk.
Meet one of the following conditions for black households:
1. The status of loan or credit card account shows abnormal status such as frozen, stopped payment and bad debts;
2. The G (Outstanding Account Cancellation) repayment status record has appeared or appeared in the last 24 months of the credit card (note: the credit card with the account status of "account cancellation" refers to the inquiry time of the last 24 months, and the credit card with the account status of "normal" refers to the last 24 months of the settlement year, the same below) (the minimum repayment amount of the credit card has not been repaid for 4 consecutive times, and credit is allowed.
3. G (unsettled account cancellation), Z (assets to repay debts) and D (guarantor to repay debts) appear in the repayment status records of loans in the last 24 months (note: loans with "settled" account status, loans with "normal" account status, the same below).
4. In the last 24 months, the cumulative number of times that the minimum repayment amount of the credit card has not been paid has exceeded 8 or 3 times (the minimum repayment amount of the credit card has not been paid for 3 consecutive times, and the quasi-credit card has been overdrawn for 6 1-90 days) for more than 2 times;
5. In the repayment status record of the loan in the last 24 months, the accumulated overdue times are more than 8 times or 3 times (6 1-90 days overdue) are more than 2 times;
6. Other individual customers who should enter the prohibited category as determined by the business department. For prohibited customers, unless the customer can prove that the above results are not caused by his own fault, provide a written explanation, and the loan approval form is signed by the head of credit business of the branch (tier-1 branch or tier-2 branch), institutions at all levels of the bank shall not engage in new credit business with them.
Legal basis:
Article 3 of the Regulations of the Supreme People's Court on Restricting the High Consumption and Related Consumption of the Executed Person stipulates that if the executed person is a natural person, after taking measures to restrict consumption, he shall not have the following high consumption and unnecessary consumption behaviors:
(a) when taking the means of transportation, choose the second class or above of the plane, train soft sleeper and ship;
(two) high consumption in hotels, hotels, nightclubs, golf courses and other places above the star level;
(three) the purchase of real estate or new construction, expansion, high-grade decoration of housing;
(four) leasing high-grade office buildings, hotels, apartments and other places to work;
(5) Purchasing non-essential vehicles;
(6) tourism and vacation;
(seven) children attending private schools with high fees;
(8) Paying high premiums to purchase insurance wealth management products;
(9) Non-essential consumption behaviors such as taking all seats of G-prefix EMU trains and first-class and above seats of other EMU trains.
If the person subjected to execution is a unit, the person subjected to execution, its legal representative, principal responsible person, person directly responsible for debt performance and actual controller shall not carry out the acts specified in the preceding paragraph after taking measures to restrict consumption. Anyone who uses personal property for private consumption to commit the acts mentioned in the preceding paragraph may apply to the enforcement court for enforcement. If the examination by the enforcement court is true, it shall be allowed.
Criminal law of the people's Republic of China
Article 196 Whoever commits credit card fraud under any of the following circumstances, if the amount is relatively large, shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and shall also be fined not less than 20,000 yuan but not more than 200,000 yuan; If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan; If the amount is especially huge or there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan or confiscated property:
(a) using a forged credit card, or using a credit card fraudulently obtained with a false identity certificate;
(2) Using an invalid credit card;
(3) Fraudulent use of another person's credit card;
(4) malicious overdraft. The term "malicious overdraft" as mentioned in the preceding paragraph refers to the behavior that the cardholder overdraws beyond the prescribed limit or time limit for the purpose of illegal possession, and refuses to return it after being urged by the issuing bank. Whoever steals a credit card and uses it shall be convicted and punished in accordance with the provisions of Article 264 of this Law.
