Under special circumstances, if it is confirmed that the amount owed by the credit card exceeds the cardholder's repayment ability and the cardholder is still willing to repay, the issuing bank can negotiate with the cardholder on an equal footing and reach a personalized installment repayment agreement. The longest term of personalized installment repayment agreement shall not exceed 5 years.

Then how to prove that the cardholder has no repayment ability? At this time, the credit card center will ask everyone to provide various supporting documents. As for what these documents are, different banks have different requirements, but usually effective documents mainly include the following categories.

1, unemployment certificate, unemployment certificate issued by the local labor department (such as unemployment registration certificate);

2. Poverty certificate, valid poverty certificate issued by the neighborhood committee or village committee where the cardholder's household registration is located; 3. Certificate of major illness. If the cardholder needs a lot of consumption due to a major illness, he can issue medical documents or relevant hospital certificates;

4. Proof of special circumstances. The special circumstances mentioned here mainly refer to the serious loss of the cardholder's property due to some irresistible factors, such as earthquakes, typhoons and mudslides. These certificates can also be issued by local authorities.

It is illegal for banks to ask for the above certificates, because there are no relevant regulations in China at present, and what information you must provide for bank credit card negotiation, so when banks implement them, the regulations of each bank are different.

But what is certain is that it is at least not illegal for banks to ask for poverty certificates and other related documents.

Article 196th of the Criminal Law of People's Republic of China (PRC) has one of the following circumstances, which constitutes the crime of credit card fraud. If the amount is relatively large, he shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and shall also be fined not less than 20,000 yuan but not more than 200,000 yuan, or if there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than 10 years, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan, or if there are other particularly serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment.

(1) Using a forged credit card, or using a credit card fraudulently obtained with a false identity certificate.

(2) using an invalid credit card

(3) fraudulently using another person's credit card.

(4) malicious overdraft. The term "malicious overdraft" as mentioned in the preceding paragraph refers to the behavior that the cardholder overdraws beyond the prescribed limit or time limit for the purpose of illegal possession, and refuses to return it after being urged by the issuing bank.

Whoever steals a credit card and uses it shall be convicted and punished in accordance with the provisions of Article 264 of this Law.
