New Rules for Overdue Credit Cards of China Construction Bank 202 1
Legal analysis: 1, improve sentencing standards.

The recent regulations have raised the standard of credit card sentencing from 1 10,000 to the present 50,000. Because people's living conditions are getting better and better, 10 thousand yuan used to be a big loan. But in modern society, 50,000 yuan is more in line with the concept of "large loan". 2. Reduce the minimum repayment amount.

According to the previous regulations, the minimum monthly repayment amount of a cardholder's credit card is 10% of the bill. Moreover, under the new regulations, cardholders can negotiate with banks according to their own conditions, and the minimum repayment amount can be below 10%. How much can be reduced can be decided according to the final negotiation result.

3. Reduce late fees.

According to the new regulations, after the credit card bill is overdue, the "liquidated damages" will be changed to "late fees". The rate of overdue repayment is 5% of the unpaid part below the minimum repayment amount.

4. About cash withdrawal by credit card.

Previously, after the cardholder used the credit card to withdraw cash, he could repay it in installments. However, the new regulations stipulate that the amount withdrawn by the cardholder in the current month will be recorded in the bill of the current month, and the minimum repayment amount must be paid off in one lump sum, otherwise it will be recorded as overdue.

Legal basis: Article 196 of the Criminal Law of People's Republic of China (PRC) commits credit card fraud under any of the following circumstances. (a) using a forged credit card, or using a credit card fraudulently obtained with a false identity certificate;

(2) Using an invalid credit card;

(3) Fraudulent use of another person's credit card;

(4) malicious overdraft.

The term "malicious overdraft" as mentioned in the preceding paragraph refers to the behavior that the cardholder overdraws beyond the prescribed limit or time limit for the purpose of illegal possession, and refuses to return it after being urged by the issuing bank.
