Extended information:

The intermediary contract occurs in the following two situations:

First, the client takes the initiative to find the intermediary.

For example, A has a house to rent. He finds Company B as a house leasing agency. Company B finds suitable candidate C among the renters registered by his company. C is a renter. The clients seeking to rent a house, A and C, have signed a house leasing contract, and Company B charges an intermediary fee (commission). According to the current trading practices of such intermediary contracts in my country, the commission is paid by the renter.

Second, the intermediary takes the initiative to find the client.

Intermediaries are often well-informed. For example, A knows that something is sold in a certain place, but B, who urgently needs to buy it, does not know. A reports the information about the conclusion of the contract to B and concludes the contract for B. Intermediary services are provided to enable B to purchase the items he needs at a certain place as he wishes, and B pays a certain amount of commission to A.

The basis of the above two intermediary contracts is an entrustment contract. In the first situation, A and C are both clients of Company B. In the second situation, although A found B first, B eventually became A's client and B paid the commission to it.
