Article 3 The steel market shall be sponsored by the municipal materials department, and the municipal planning commission, industry and commerce, price, taxation, auditing, banking, finance and other departments shall participate in the supervision and management according to law. Article 4 The following steel products must be sold through the market:

1, steel sold by steel production enterprises at or above the county level (except for the connection between production and demand and the overall planning of resources organized by the national and municipal materials departments);

2, imported steel (excluding the import and export of economic and trade departments and the provinces and cities into the tax relief arrangements for imported steel);

3. Steel in national and local markets;

4. Using scrap steel to process steel;

5, the use of unit inventory is redundant, because the varieties and specifications are wrong, and the steel sold by the supply and marketing institutions of competent departments at all levels is indeed redundant in this system;

6, from outside the organization transferred to the legitimate business units of steel;

7, non production and operation or non-use units, approved by the Municipal Planning Commission, the Municipal Administration for Industry and Commerce issued a one-time steel temporary business license. Article 5 The following steel products may be sold without going through the steel market:

1, steel produced by steel enterprises at or below the county level with self-produced steel;

2, material enterprises at all levels and their supply outlets directly supply users and steel products sold in the direction specified by the material management department;

3. Supply and marketing cooperatives of various departments and their outlets supply steel products directly under their own departments;

4. Steel products sold by supply and marketing companies of township enterprises below the county level and supply and marketing cooperatives below the county level entrusted by the materials department according to the approved business scope. Article 6 Examination of Access Qualification

1. Traders entering the market must be approved business enterprises, steel production enterprises and steel users.

2, according to the provisions of article 4 of the sales of steel, in principle, must be set up on the spot, with the "business license of enterprise legal person" issued by the administrative department for Industry and commerce (or copy) and relevant documents, to the market management office to apply for admission registration, before sales.

3. To sell the steel products listed in Item (4) to Item (5) of Article 4, the seller must obtain the Approval Form for Adjustment, Adjustment and Management of Steel Products from the Steel Market Management Office before the sale, and the opinions shall be signed by the competent department of the distributor and reported to the Steel Market Management Office for approval before entering the market for sale. Article 7 Principles and trading methods of steel entering the market

1. Trading activities in the market should be carried out under the guidance of the principle of inclined supply in the national industrial policy, giving priority to meeting the needs of the city's production and maintenance, export, high-quality brand names, hot-selling products in the market, key infrastructure and technology introduction projects.

2. The trading method can be spot or futures trading; You can also take direct transactions between production and demand; Can also be entrusted to the corresponding business scope of material management enterprises or entrusted to the market procurement, consignment, storage, transportation, adjustment and settlement.

3. On-site transactions must be "four open" in terms of resources, prices, transactions and settlement, and cash transactions are not allowed. Article 8 Flow direction of incoming materials (sales target)

1, iron and steel production enterprises in accordance with the provisions of the self-marketing resources, can be sold to legitimate business enterprises and the use of units, production enterprises.

2, material management enterprises, can be directly sold to the use of units, can also be sold to different regions, different levels of material management enterprises.

3. The supply and marketing organizations and users of the competent department of the enterprise can directly hand over the resources with redundant inventory or wrong varieties to users and material supply organizations with direct supply tasks, or they can also hand them over to material management enterprises for acquisition or consignment.

4, non production, operation or non-use of steel units, approved one-time operation of steel resources, can only be sold to the approved object.

5. The development resources of the material cooperation joint venture shall be sold to users in principle. Article 9 Supervision and management of market trading activities

1, all steel products put on the market shall be clearly marked, and the transaction price shall be negotiated and agreed by the supplier and the buyer in principle; If the country or province has a unified maximum price, it shall be implemented in accordance with the regulations.

2. Steel products put into the market must hold the product certificate or warranty issued by the production enterprise (imported steel products must have the commodity inspection certificate); For products without product certificate or warranty or defective products with use value, the sales unit shall issue a quality specification.

3, according to the provisions of the state must enter the steel market sales of steel, in principle, should be through the bank settlement, not cash transactions, and should be used by the materials department stamped with the "special seal for Xiamen steel market" unified invoice book.

4. Sales units with large steel resources and frequent market transactions must report the expected variety, specification, quantity, price, manufacturer's name and address, etc. Declare to the market management office on a monthly basis before sales, and issue a special version of the corresponding unified invoice after being audited by the market management office and the competent tax authorities. After sale, the sales unit regularly submits the actual sales situation to the market management office in the form of monthly report.

Other sales units in the market sell steel, and the steel market service agencies issue invoices uniformly.

5. Where the spot steel is traded in the steel market, the invoice issued by the sales unit (including the market service organization) must be verified by the market management organization of the Municipal Administration for Industry and Commerce and stamped with the "Special Seal for Steel Trading Verification of Xiamen Administration for Industry and Commerce" before it can take effect. Otherwise, the bank will not handle the settlement procedures, and the transportation department may not transport them.

The sales invoice verified and sealed by the market management organization of the Municipal Administration for Industry and Commerce is the proof of the legal transaction of steel products sold by enterprises. Except for other special circumstances, the relevant administrative law enforcement organs will not repeat the inspection.

6. Where steel futures are traded in the steel market, the sales unit must use the text of the economic contract under the unified supervision of the Municipal Administration for Industry and Commerce, and timely apply for verification with the on-site management organization of the Municipal Administration for Industry and Commerce in the direction of purchase.

7. Business units approved by the Municipal Steel Market Management Office shall not enter the market to set up sales, but they must obey the unified management of the Market Management Office and use unified invoices for the steel market. If the single steel transaction amount is more than 654.38+10,000 yuan, it must go to the steel market in accordance with the relevant provisions of these Measures to apply for verification and seal from the market management agency of the Municipal Administration for Industry and Commerce; Submit the actual sales situation to the market management office every month, and submit the unified invoice stub for that month.

8, the relevant units (departments) in the city to organize steel fairs, transfers; The organizer shall report to the municipal steel market management office in advance, and the market management office shall send personnel to attend the meeting to supervise and verify and affix their seals according to law.

9, into the unified management of steel market transactions, sales units must pay taxes. Except for the steel products put into the market by the state and local governments, according to the principle of "taking them from the market and using them for the market", the market management office can charge the sales unit management service fee at the rate of 65438+ 0.5-2% of the turnover, which is mainly used to pay the service and office handling fee.

10, the price difference income of steel inside and outside the plan approved by the Municipal Planning Commission, or the price difference income from planned sales to unplanned sales, shall not enter the profits of the enterprise, and must be accounted for separately for special use. The price difference income of the user unit shall be used to repurchase the price difference subsidy for similar applicable varieties.
