Legal analysis: it depends on whether the employee participates in illegal business practices and the role it plays. Employees of the company who knowingly participate in illegal business operations shall be punished according to the amount of profits gained from participating in illegal business operations. If the amount is not up to the filing standard, it shall be punished according to Article 49 of the People's Republic of China (PRC) Public Security Administration Punishment Law. If the amount reaches the filing standard, the criminal suspect shall be convicted and sentenced for the crime of illegal business operation. As long as there is evidence to prove that it plays a secondary or auxiliary role in the same crime, as long as it is recognized as an accessory, no matter whether the principal exists or not, it should be given a lighter, mitigated or exempted punishment in accordance with the provisions of the Criminal Law on accessory.
