How to take annual leave?
The number of days specified in the annual leave is based on the working years, as follows:

1. Those who have worked for 1 year but less than1year can enjoy 5 days of annual leave;

2. Those who have worked continuously for 10 years but less than 20 years can enjoy 10 days of annual leave;

3. Those who have worked continuously for 20 years can enjoy 15 days annual leave.

It should be noted that if the employer cannot arrange annual leave, it shall calculate overtime pay according to three times of legal holidays.

The conditions for annual leave are as follows:

1. Enterprises, private non-enterprise units, individual industrial and commercial households with employees and employees who have established labor relations with them can all take annual leave;

2. Employees who have worked in the enterprise for 12 months are entitled to annual leave;

3. If the employee does not take annual leave, he shall pay three times the daily salary, unless the employee voluntarily applies in writing;

4, winter and summer vacation, sick leave, personal leave for more than a certain period of time, and the single silent position does not deduct wages, can no longer take annual leave;

5. For employees whose annual leave should be taken one year before New Year's Day, but less than one year, the rest days of annual leave are determined according to the remaining calendar days in the company, and the part less than 1 whole days after conversion is not entitled to annual leave.

Statutory holidays are not included in the annual leave, that is:

1, New Year's Day: stipulate 1 day holiday 1 day;

2. New Year's Eve requires a three-day holiday from Lunar New Year's Eve (1February 29 or 30) to the second day of the first month;

3. Tomb-Sweeping Day: Tomb-Sweeping Day is required to have a holiday 1 day;

4. Labor Day: May 1 day holiday is stipulated 1 day;

5. Dragon Boat Festival: it is stipulated that there will be a holiday on the Dragon Boat Festival 1 day;

6. Mid-Autumn Festival: stipulate the Mid-Autumn Festival holiday 1 day;

Legal basis: Article 2 of the Regulations on Paid Annual Leave for Employees.

Employees of government agencies, organizations, enterprises, institutions, private non-enterprise units, individual industrial and commercial households with employees and other units who have worked continuously for more than 1 year are entitled to paid annual leave (hereinafter referred to as annual leave). The unit shall ensure that employees enjoy annual leave. During the annual leave, employees enjoy the same salary as during normal work.
