Article 130 A suspended sentence shall not apply under any of the following circumstances:

(a) the amount of misappropriation of funds is more than 400 thousand yuan or the amount of misappropriation of funds for illegal activities is more than 6.5438+0.5 million yuan;

(2) Not all stolen goods have been returned;
