(a) in line with China's environmental protection and sustainable development strategy, principles and policies;
(2) Specific areas, such as climate change, biodiversity, international waters and land degradation related to these areas;
(3) It has global environmental benefits;
(four) in line with the principle of additional funds and co-financing. Article 3 The Ministry of Finance shall be responsible for the unified supervision and management of the projects funded by the Fund. Its main responsibilities are:
(1) Attend relevant meetings of the Fund together with the Ministry of Foreign Affairs, the State Environmental Protection Bureau or relevant competent departments, review and sign relevant agreements on behalf of the China Municipal Government, and pay China's contribution to the Fund on time;
(2) On behalf of the China Municipal Government, submit or confirm China's recommended projects to the fund secretariat or fund executing agency, negotiate relevant projects with the fund and its executing agency, and sign project documents such as grant agreements;
(3) signing a project implementation agreement with the project unit, approving the use plan of capital grants, project procurement plan and overseas study and training plan for non-investment projects, and uniformly managing the special account for funds;
(four) in conjunction with the State Environmental Protection Bureau to supervise the implementation of approved projects, coordinate and solve disputes arising in the preparation and implementation of projects, correct violations, and organize the acceptance and post-evaluation of completed projects. Article 4 The project application procedures are as follows:
(a) the fund project applicant shall, in accordance with the prescribed format, prepare the Project Application Form, submit it to the Ministry of Finance through the central industry competent department or the provincial finance and competent department where the project is located, and send a copy to the State Environmental Protection Agency.
(2) The Ministry of Finance and the State Environmental Protection Bureau shall organize experts to conduct technical review, and relevant departments may send experts to participate in the technical review.
(3) After comprehensive balance, the Ministry of Finance, together with the State Planning Commission and other relevant departments, formally put forward the project according to the submission procedures of the fund and its implementing agencies, and feedback the opinions of the fund and its implementing agencies to the project unit as soon as possible.
(4) After the project concept is approved by the Fund, the Ministry of Finance will apply to the Fund for foreign exchange expenses related to the project preparation according to the specific conditions and needs of the project.
(5) Whether joint financing is needed for investment and construction projects shall be reported by the project unit to the relevant state departments according to the project concept approved by the fund and the approval procedures for investment in fixed assets. Investment projects that need to be jointly built with other foreign capital should be included in the national plan for the utilization of foreign capital first, and then submitted for approval according to the examination and approval procedures for the utilization of foreign capital. The State Planning Commission is responsible for examining and approving the plan for the use of funds for investment projects. Article 5 The project unit is mainly responsible for the preparation and implementation of the project.
(a) once the project is approved, the project unit shall establish a corresponding project management organization, equipped with project management personnel with strong professional and foreign language skills, and provide corresponding office facilities and funds;
(two) to ensure that the matching funds needed for the implementation of the project are raised in place, and strive to raise funds from other channels outside the fund;
(3) The procurement of goods, the hiring of consultants, overseas study and training, the withdrawal of grants, and the audit of financial reports conducted by the Fund shall comply with the relevant standards of the Fund and its implementing agencies and the relevant provisions of the Ministry of Finance;
(4) submit semi-annual project implementation report and annual project implementation report to the Ministry of Finance every six months, and send a copy to the State Environmental Protection Bureau. Article 6 The project unit shall accept the annual financial audit of the project by the National Audit Office and the inspection of the use of funds and accounting records by the Ministry of Finance. If it is found that the project unit uses the project funds for other purposes or does not implement the project in accordance with the prescribed project plan and content, the Ministry of Finance will stop paying the project funds and hold the project unit responsible. Article 7 After the completion of the project, the project unit shall submit the project implementation summary to the Ministry of Finance through its central competent department or provincial financial competent department within 3 months, and send a copy to the State Environmental Protection Administration. The Ministry of Finance shall, within 3 months from the date of receiving the project implementation summary submitted by the project implementation unit, jointly with the State Environmental Protection Bureau and relevant project ministries, funds and their implementing agencies, make a post-evaluation on the project implementation. Article 8 The Ministry of Finance shall be responsible for the interpretation of these Provisions and shall come into force as of the date of promulgation.
