Charity activities should follow the principles of legality, voluntariness, honesty and non-profit.

This Law is formulated for the purpose of developing charity, promoting charity culture, standardizing charity activities, protecting the legitimate rights and interests of charitable organizations, donors, volunteers and beneficiaries, promoting social progress and enjoying the fruits of development. Natural persons, legal persons and other organizations shall carry out charitable activities and activities related to charity, and this Law shall apply. Where there are special provisions in other laws, those provisions shall prevail.

Charitable activities mentioned in this Law refer to charitable activities carried out by natural persons, legal persons and other organizations by donating property or providing services. The principles of legality, voluntariness, honesty and non-profit shall be followed, and it shall not violate social morality, endanger national security, harm social public interests and the legitimate rights and interests of others. The state encourages and supports natural persons, legal persons and other organizations to practice socialist core values, carry forward the traditional virtues of the Chinese nation, and carry out charitable activities according to law.

The civil affairs department of the State Council is in charge of the national charity work, and the civil affairs department of the local people's government at or above the county level is in charge of the charity work within its administrative area. The relevant departments of the people's governments at or above the county level shall, in accordance with this law and other relevant laws and regulations, do a good job in relevant work within their respective functions and duties. September 5th every year is "China Charity Day".

Charitable organizations can take the form of foundations, social organizations and social service institutions. The establishment of a charitable organization shall apply to the civil affairs department of the people's government at or above the county level for registration, and the civil affairs department shall make a decision within 30 days from the date of accepting the application. Those who meet the requirements of this law shall be registered and announced to the public; If it does not meet the requirements stipulated in this law, it shall not be registered and the reasons shall be explained in writing.
