The fire safety of houses, the safety management of elevators, gas, water supply and other professional facilities and equipment, the disposal of illegal buildings, the safety management of the use of cultural relics and historical buildings, and the safety management of houses in historical and cultural blocks, historical and cultural towns, historical and cultural villages, historical areas, traditional villages, military protected areas and places for religious activities shall be implemented in accordance with the provisions of relevant laws, regulations and rules. Article 3 The use of houses shall follow the principles of legal use, giving priority to prevention, combining prevention with control, and ensuring safety. Article 4 The municipal and district people's governments shall strengthen the leadership and supervision over the safety management of housing use within their respective administrative areas, and organize and coordinate relevant departments to do a good job in the safety management of housing use. Fifth Municipal People's government housing management departments to implement unified supervision and management of the city's housing use safety, and organize the implementation of these provisions. The housing management department of the District People's Government shall be specifically responsible for the supervision and management of the safety of housing use within its jurisdiction.
Housing management departments (hereinafter referred to as housing administrative departments) can be entrusted with the organization and implementation of housing use safety appraisal, dangerous housing management, termite control and other functions. Responsible for the specific affairs of housing use safety management.
Planning, construction, development and reform, finance, transportation, public security, emergency management, civil affairs, education, market supervision and management, gardens, culture, urban management and other departments responsible for comprehensive law enforcement shall, in accordance with these Provisions, cooperate with the safety management of housing use. Sixth Town People's government, street offices shall assist the people's governments at higher levels and relevant departments to carry out housing safety investigation, supervision and management of dangerous houses and emergency rescue work. Article 7 The municipal and district people's governments shall give full play to the role of trade associations such as house use safety appraisal, termite control and property management in house use safety management, and encourage and support trade associations to carry out their work according to law.
Industry associations shall cooperate with the housing administrative departments in accordance with the law to do a good job in the safety management of housing use, and carry out industry self-discipline and supervision. Eighth city housing administrative departments shall regularly organize the city's housing safety survey, the establishment of housing safety dynamic information management system, to achieve the sharing of housing safety management information between the people's governments at all levels and their departments. Article 9 The municipal housing administrative department shall disclose the following information to the public in the dynamic information management system of housing use safety:
(a) housing safety appraisal units, termite control units for the record and integrity evaluation. ;
(two) the housing safety appraisal unit, the termite control unit and the person in charge of housing safety are subject to administrative punishment for violating the laws, regulations and rules on housing safety;
(three) the basic information of the housing use safety appraisal report;
(four) other information about the safety of housing use.
The municipal housing administrative department shall disclose the safety information of housing use, and shall not involve state secrets, commercial secrets or personal privacy, except as otherwise provided by laws and regulations.
The municipal housing administrative department shall provide convenience for citizens, legal persons and other organizations to inquire about the safety level of housing use through the housing address. Article 10 The municipal and district people's governments shall include special funds for housing use safety management, such as housing use safety investigation, emergency rescue, and dangerous housing escrow, into the fiscal budget to ensure the needs of housing use safety supervision and management. Chapter II Responsibility for the Safety of House Use Article 11 The owner of a house is the person responsible for the safety of house use. The whereabouts of the owner of the house is unknown or the ownership of the house is unknown. If there is a custodian, the custodian is the person responsible for the safety of the use of the house; If there is no custodian, the right to use the house is the person responsible for the safety of the house.
The management unit of public housing is the person responsible for the safety of public housing.
The owner of the right to use the house shall bear corresponding responsibilities for the safety of the use of the house in accordance with the provisions of laws and regulations and the contract. Article 12 The person in charge of housing use safety shall bear the following responsibilities for housing use safety:
(a) the rational use of housing in accordance with the planning and design requirements and the purposes recorded in the real estate ownership certificate;
(2) The house decoration complies with the relevant provisions;
(three) inspection, maintenance of housing, timely elimination of housing security risks;
(four) in accordance with the provisions of the housing use safety appraisal;
(5) controlling termites;
(six) other duties as prescribed by laws, regulations and rules.
The person in charge of housing use safety shall cooperate with the general survey, inspection and emergency rescue activities of housing use safety organized by the people's governments at all levels and the housing administrative department of this Municipality. Article 13 A realty service enterprise shall cooperate with the publicity on the use safety of houses, undertake the daily management responsibilities such as inspection, evaluation, repair and maintenance of some facilities and equipment used in the realty management area according to the decision of the owners' meeting or the stipulations in the realty service contract, and establish corresponding management files.
The daily management responsibility of the exclusive part of the house shall be borne by the person in charge of the safety of the use of the house according to law. There are security risks in the exclusive part of the house, which endanger the public interests and the legitimate rights and interests of others. The person responsible for the safe use of houses shall promptly eliminate potential safety hazards; If the potential safety hazard is not eliminated in time, it can be maintained by the property service enterprise with the consent of the owners' meeting, and the expenses shall be borne by the person responsible for the safety of housing use.
The realty service enterprise shall promptly report to the owners' committee or notify the person responsible for the safe use of the house, post an announcement in a prominent position in the property management area, and take protective measures such as warning and enclosure as needed.
* * * The maintenance and renewal costs of some facilities and equipment used in the house can be charged from some operating income, special property maintenance funds and unit housing maintenance funds according to regulations.
