I. Housing Maintenance Fund Inquiry
1, the maintenance fund belongs to all owners * * *, and a special account should be set up for special purposes, which will be inspected and supervised by the owners' meeting and the owners' committee on a regular basis. Maintenance fund detail households are generally set according to a single house. Housing maintenance funds can be inquired at the local housing provident fund office.
2. According to the Property Law of People's Republic of China (PRC), there are clear provisions on the ownership and use of public maintenance funds: the maintenance funds of buildings and their ancillary facilities belong to the owners. With the consent of the owner, it can be used for the maintenance of elevators, water tanks and other parts. The collection and use of maintenance funds shall be announced.
3. The unit selling houses shall transfer the maintenance fund collected to the local real estate management department for escrow before handling the property ownership certificate for the owners. Conditional community, the owners' committee submitted to the owners' congress for decision, can be entrusted to the owners' committee or property management company for the maintenance fund. If the maintenance fund is managed by the personnel of the property management department, the personnel of the property management department shall not interfere with the normal use of the maintenance fund.
4, the use of maintenance funds by the property management company put forward the annual use plan, approved by the owners' committee, the owners' meeting before implementation. When the maintenance fund is insufficient, the property maintenance fund shall be paid according to the decision of the owners' committee and the proportion of the housing construction area.
Second, the use of housing maintenance funds must meet the conditions.
1. The special maintenance funds were collected in full, and the maintenance projects were in line with the scope of maintenance funds.
2. The warranty period of public parts and public facilities and equipment expires.
3, involving the property management area or all the owners, has been agreed in writing by the owners' meeting, and the exclusive part accounts for more than 2/3 of the total construction area and accounts for more than 2/3 of the total number of owners.
Three, housing maintenance fund payment method
When selling commercial housing, the purchaser and the selling unit shall sign the relevant maintenance fund payment agreement, and the purchaser shall pay the maintenance fund to the selling unit according to the proportion of 2-3% of the purchase price. The maintenance fund collected by the selling unit belongs to all owners and is not included in the residential sales income. The current deposit standards of the first special maintenance fund are: 90 yuan per square meter for high-rise buildings (including multi-storey buildings with elevators) and 50 yuan per square meter for multi-storey buildings (including villas).
Under normal circumstances, the housing maintenance fund is managed by the real estate administrative department. After the establishment of the owners' committee, the public maintenance fund will be handed over to the industry committee, which will exercise the management right.

Measures for the administration of residential special maintenance funds
Article 7 The owners of commercial residential and non-residential houses shall deposit special maintenance funds for houses according to the construction area of their own properties, and the amount of the first special maintenance funds for houses deposited per square meter of construction area shall be 5% to 8% of the construction and installation cost of local houses per square meter. The competent departments of construction (real estate) of the people's governments of municipalities directly under the central government, cities and counties shall, according to local conditions, reasonably determine and announce the amount of the first-phase residential special maintenance fund deposited per square meter of construction area, and make timely adjustments.
